So a mortgage company was foreclosing one of their properties with a similar address to mine in my ny neighborhood. They hired a property company who sent out a contractor. (three parties involved now). The contractor came to my house broke in and locked my door with dead bolts. I was locked outside of my house for more then 5 hours before they came to let me back in. Not to mention they left it up to me to figure out what happened and correct it. Besides making them pay for damages do you think I have a reasonable case to sue for anything punitive.. *I.e. being locked outside in front of my neighbors in my townhouse community,The stress of the situation and not know what was going on, the time and trouble of dealing with this on the phone, and having to make time for new contractors I have hired to come out and repair items..*

You'd probably have to prove they did it deliberately and maliciously. It sounds more like accidentally the way you describe it. |

You may want to consult with a lawyer in regard to punitive damage award, a main question did your neighbors witness the act? Can you find the company acted in a reckless manner? Etc
Side note: can you try pressing criminal charges for breaking and entering, and intentional damage to the property? |
