A good life in the works definitely deters judges from long sentences, I knew someone with almost the same situation and he was put on probation after a 72 hour sentence. The bad part is it is now on his criminal record forever, which will make things like promotions and getting a passport more difficult. With no priors and a decent living, it is impossible for him to receive a detainment sentence, he will be out in no time and will be on probation for awhile, with any luck he can also have it removed from his record if he never ever gets caught again.
You will be just fine, nothing to worry over. :-)

well i hope he gets locked up for a long time! i HATE it when guys are burn-outs. if you really cared about him, you would want him to learn his lesson. go ahead and report me. they won't do anything about it because i'm just giving my honest opinion. |

This should teach him to not do it again. And maybe he shouldn't be doing these things ya know? Find new friends, hopefully he'll get off easy. But with election season they're always looking to make an example out of someone. |

He shouldn't get into too much trouble, hopefully he gets out fairly soon. Why don't you bail him out? They'll probably release him on Monday, but the 'intent to sell' thing is a little unnerving. If he has no prior conviction then he should be fine. Please don't worry so much I know you'll get to see him again soon:) He'll probably just have to do a year of probation take drug tests and shell out a bunch of money for drug and alcohol classes. |

there's more to it than you have stated. they don't charge you with intent unless he had a scale or something, a bunch of small pre-packs or an eye witness to some transactions. a small amount of weed by itself is nothing. people get 6 to 12 mons for intent when they have no priors. i'm not saying every one. maybe he didn't tell you the whole story.
moving is part of distributing. best thing to do now is try to get a deal to drop the distributing and plead to possesion. |

If he has no prior record then he should get off pretty easy. The best thing you can do is support him and when he gets out do your best to try and help him avoid these kinds of situations in the future. |

It has to be more than "a little bit" for him to get intent to sell. Don't stress his life. He made the choice; he has to live with it. You need to go on with your life. Can't say you haven't been told. |

Well, california has the most liberal marijuana laws of any state, so this is a plus.
But i guess it depends how much he has. Im farily certain (dont quote me though) that anything over an ounce is considered intent to deliver. The most he would get would be 5 years.
If this is his first offense, he has an education and a good job, and he has not had any police involvement in his past, more then likely he will be put on probation. Being said, if he has a pound, then hes in much more trouble, and those things might not help him. |

honestly it really depends on his age and how his outward appearance is in court. the fact that he has not had any priors is a good thing but not always, California is supposedly cracking down on drug offenders, but if he didn't resist arrest and was respectful to his arresting officer (because sometimes they will speak in his defense) he's probably going to get let off with court costs and a few fines. keep faith and make sure this is a wake up call to him, the second time around he might not be so lucky. You don't want to end up with this guy if he continues to do this, you'll end up getting involved. |

Get a hold of yourself. You said it is he who did wrong. So let him suffer the consequences.
Believe me it wil be beneficial for him and you in the future.
It is better for him to pay now than later. If he does not get punished now, he will continue to do wrong and will get into much bigger trouble.

depending on how he handles himself in front of judge, what he looks like, & his attorney, then there is chance he could walk with a suspended sentence or probation... i am assuming he is 18 or older... the best scenario is as follows and any deviation will rightly or wrongly deter judge from going easy on him:
in college
getting good grades
has attorney who is good & not in a hurry
no visable tattoos
short hair but not shaved
acts humble & polite in court
no priors or currents
offers to plead guilty for deal
#1 issue is if he is respectful to judge, sir or maam ALWAYS, no yelling or whining, no dirty looks, a tear in the eye might even help |

Honestly, I dont know the laws...however, I do know of people who just got probation for possession and had to pay fines ...and if hasnt ever had anything on his record before I wold say he's good to go on that. Im sorry I dont know the actual laws but from my experience of seeing other people get caught with it, they typically get off pretty easy the first time. Get to feeling better and everything will be okay dear! |

I'm not sure really, I live in AZ and I got introuble with possesion of weapons and because it was my first offence they gave me 3 years probation but i ended up getting off a year and a half early for good behaviour. It depends really. Basically what I had to do for probation was every once in a while i had to take drug tests and i had to pay a $50 fee a month and see my probation officer once amonth.
I would assume that because its his first offence he won't get anything too serious. |
