Am I legally responsible to pay them back, after all they took a picture of me without my consent and it was an accident. Additional Details Can someone give me proof of this with a website, that states if im legally responsible. Im Canadian BTW British Columbia to be specific

News photographers get that treatment always and they always win; so pay for the camera and move on.
By law anyone don't need your consent to take a picture if you are on a public place; if they cross the harassment line then you can take legal actions BUT not physical actions.

The problem here is that you took justice on your own hand (trust me the Judge is not buyin the "oops accident" claim) so even if the picture taking were (hypotetically) ilegal you are still responsible for your part. |

your picture is worthless to some people, and may be worth something to others.
when courts look at this, you know what they do?
they have you arrested for assault , take your picture at the police station, then laugh while you spend the night in jail and they draw on your picture with a permanent marker.
Seriously, i'd take a picture of you all day long and just destroy the film when i got home because you are nobody |

So you pose a question then you ask people to prove what they are saying simply because you did not receive the response you wanted.
Unless this person broke into your house and took pictures of you in the nude, you had absolutely no right to touch the his/her camera. And although the police would not get involved in this type of case, the person could file a civil suit in small claims court. However, you really shouldn't let it reach that point because you are legally and morally responsible for your actions. |

Yeah, I'd say so. You could have always sued them for the photograph.
Personally if I took a picture of you and you broke my camera over it I'd use what was left of the camera to beat you with. |

Whether you would be legally responsible is hard to say without knowing all the facts, but most of the time that old cliche that two wrongs don't make a right is true. If they took your picture without permission, you may have had some legal remedies available to you, but breaking their camera was not one of them. |

Of course you are responsible. If you were in a public place you are limited in them not being able to take a picture that included you. |

Morally, it is your decision whether or not to pay for the camera. You are in an interesting situation, and it is difficult to determine if you should. If you were in a hurry and bumped into someone because you were being reckless and made them drop and break it, I'd say you should. However, you requested not to have your picture taken, and they were not listening to you.
Legally, it will be difficult for the person who's camera broke to get any law enforcement to say you owe them for the camera.
Someone once literally ran into my girlfriend carelessly, causing her to drop and break her ipod. She went to her campus police, and they would not help her. |
