5 mos. ago, I was hired as an accounts payable but my employer hired me under 1099 as an outside help. I was treated as a full time employee, paid hourly, getting overtime benefits. Today, I was told that my services are no longer needed. Just like that. My big question is, can I collect unemployment benefit even if I was classified as 1099? my previous employments were w-2. By the way, I'm currently living in California right now ( I heard laws vary from state to state) Pls. somedy help me on this, I'm so heartbroken and confuse. Thanks in advance guys

fyi, I just started working last year, my previous employments were only less than 3 mos. total but was employed as w-2..

Your benefits are based on the last 4 quarters. So if you worked for him for 5 months you still have qualifying wages. 4 quarters is 12 months. Also if you were 1099 those 5 months would only qualify if you paid into the system, which I am guessing you did not. So you will have 7 months of qualifying wages, so yes you will collect for a while, depending on how much your qualifying wages were, will determine the number of weeks you can collect and the weekly benefit amount. |
