Can Employers Be In Trouble if They Fire Someone for being Sick?

Especially with this new swine flu? I know of places that make a person come in and get their temp. taken to prove they are sick. This is so ridiculous! I know as a customer, I wouldnt want a person coughing or sneezing on my food or things Im buying, Id rather they stay home and get well.
I personally worked at places that fired people or wrote them up for being legitimately ill and missed several days, got notes from the doctors, etc. These werent habitual calloffs, good workers who rarely missed work unless they were sick.
So, with the swine flu going on, and there's likely to be people missing work, shouldnt employers be held accountable if they start firing people for being too sick to work?

Yes an employer could be sued for doing such a thing. If someone is sick and has a note from a doctor then yes an employer could be sued! An employer is not a legal doctor, medical records are private, if they have a note they need to give you time off according to the doctors advise. |

No. The flu is not widespread enough to use that as an excuse to skip work at this point. |
