Yes, actually---I'm sure they could prove your "intent to deliver" because you're in the alley and all that.. and, of course, "bags of sugar" would be labeled a look-alike substance.
And the prosecuting attorney would seal the deal with "Why would anyone sell sugar in baggies in the ALLEY, when there is a QUIK-E MART on EVERY CORNER where sugar is readily available??"

I screwed CID over one day... as they where leaving I entered me kitchen, using salt, sugar flour and xxxxx I made a lil baggie of something that looked like it wasn't. Left it on me kawphee table.
Few days later, CID thru me door... What this then? ur nicked.
I spent lil time in cell, couldn't sue em for wrongfull arrest. And they never figured owt exactly what was in there... |

I am pretty sure he could arrest you and charge you, however you probably would not be convicted of the charges. You may be convicted of something else like attempting to hinder counter drug operations or some such thing. |

I think you need to ask the question, What am I going to get in return for scamming the cops.. I have been there and done that and they will mess with you bad if you take them for fools.. Plus, they will arrest you and make you wait till they can find a kit or lab to test the "sugar" This may take some time for them as im sure they are going to drag thier feet! Good luck on that one! |

Yes you can be arrested for selling a substance that is set up to look like drugs. If you got a good lawyer you could probably get off, but you will still have gotten arrested. |

Yes. selling placebo(sugar,oregano,drywall compound,etc.)is considered attempt to sell and traffickking. In the end,you could be convicted on three counts. The technical names for the charges fail me,but i know it has to do with posesion of paraphernalia and dealing fake drugs,on top of you sale and trafficking charge. You should think hard before you try to pass bayer pills for X. The least I worry about is jail. I'd be more concerned by the junkies kicking my butt over fake blow. |

So many answers to this question, and so many are wrong. Yes, you can be arrested and charged. You are attempting to pass the sugar off as a controlled substance, which would make it sale of a counterfeit CS. |

They could arrest you and then the lab would take 2 days to get the results of the chemical test back to them. (This happened to someone crossing the border with a bag of baking soda one time).
It's your time so if you want to spend it in a cell I guess that is your choice :) |

You can be arrested for suspicion of selling an illegal narcotic. I would advise against this because if a cop sees you and they don't have a field test kit ready you will go to jail, and you won't get your bail money back.
The charges would be dropped or at least reduced to a non-drug related offense, but why risk it? |

Yes, I forgot what it's called, but this guy got arrested on Cops because he was pretending to sell and it was packaged in the same manner as drugs. It is an actual crime, plus you could probably get hurt by real criminals who think you're on their turf or by angry customers who come back for vengeance. |
