From your description of the events, I would say you started it. As the instigator, you are guilty of assault--that's trying to hit someone ("battery" is succeeding). If your throw is so bad that you were close to hitting someone else, then others do have the right to restrain you and keep you from further risking harm to another.
Thus, your brother pinning you down initially sounds over-reactive, but it could also be presented as restraining you and your violent impulses of throwing things that threatened another. See where I'm going here?
The "hitting" part will be the crux. First, was he really hitting you? Or did you interpret as "hitting" his actual attempts to restrain? And if he was hitting you, was the hitting over-reaction or further, needed attempts to restrain?
You see the problems you have when you're the one with the first violence? The law is suddenly on everyone else's side, even if you were to have some valid claims. |

Soooo let me get this staight: You threw things at your brother and his daughter was there. You endangered her by throwing things at him which could have possibly hit her. You did that because he was throwing you down and hitting you. Then you called the cops.
