I just served my ex (who is married for 7 yrs) a summons. I need her to take me off of paying child support for my 13 yr old. I've never paid or spent time with my son. I have an order of support she put on me, but I don't get a real job cause I knew they would garnish me. I take and get off the book jobs so I can keep my money. Now, what are my chances of getting this court order permanently taken off and all of the $60,000 in arrears I owe erased. Please tell me I can do this by taking her to court. I can't get a Driver's license, a Passport, nothing..cause of this woman. Shes married and I'm here miserable with girl after girl..but anyway, I can't get a job on the books because of this order, so im taking her to court. Will I win and did any guys out there do this an end up having the order terminated? Im serious. Thanks

Nope, not only will you be liable for the $60G's PLUS interest, you are still responsible for the child until he reaches his majority, another five years.
It's not your ex's fault you didn't get a job, that was you trying to be clever. You did this to yourself, "this woman" did not do it to you.
If you'd even made an *effort* to pay, you could have your license and passport. Child support is for the *child*, not the ex, so her current or future marital status is irrelevant.
No sympathy for you here, oh impotent Ruler, and I guaranTEE the courts will have no mercy on you either.
I suspect the second you step into that courtroom you will be arrested and sent to jail.

Arrears in child support cases are permanent, they can not be taken away. They are debts you owe, they can and will be taken out of tax refunds (if you ever get a legit job) if need be, they are expected to be paid and can land you in jail if no attempts to pay are made.. Your ex can (if she chooses and if a judge complies) stop future payments, but arrears never go away until paid in full.
Whether or not you see your child is moot in cases of support, you, just as the child support recipient has right to get support - you have right to fight for visitation... a fight you have not attempted. So forget that fact that you have not seen the child, it is irrelevant in your case. |
