Can I legally sell a photo that I took of someone else's sidewalk artwork?

I took a photo of artwork that was created on a sidewalk in downtown I'm selling prints of photos that I've taken and one of the photos that people have requested is a 3 dimensional piece of sidewalk artwork by famous artist Julian Beever. You can view the photo here:

My question is, since this was a piece of artwork that was on the sidewalk, not in a gallery, similar to graffiti or a mural, is it legal for me to make money off of the photo that I took of it? The artwork was removed a week after it's completion.
Additional Details
An art gallery is a private business institution. It would be on their property or inside their walls so that is different than sidewalk artwork which takes place on public property. How is it any different than selling a photo of a sand castle on a public beach?

You could do it but you might get sued for doing so.It does belong to the artist but he's the one who put it out on the sidewalk.I believe it would be morally wrong but I'm not as sure as all the others as to whether or not it is illegal to do so.It was displayed for anyone too see.That's kind of like saying it's illegal to sell the image of a celebrity and we all know that's not true.

No you may not. It doesn't matter where it was, it did not belong to you.

No you must get permission of the artist himself to be able to sell his image. You have to give credit where credit is due. Nice photo though.

No. Julian Beever makes his living by these commissions. Would you go into an art gallery, take pictures of other people's work, and sell that?

Edit: It has to do with intellectual property rights. It doesn't matter if it's a private gallery, public gallery, or a public park. You are attempting to make a profit from someone else's artistic works. A building isn't the same thing. Putting aside the ethical side, if you intend to pursue this, you better make sure you have a good attorney that specializes in this field.
