Can I legally smash the window of this car and then roll it out the way?

I pay for a secure underground parking in the City.... with my own space in an underground car park. It's £165 pm which is a lot of money.. but only about £25 pm more than the public car parks, with added convenience of being closer to work, and open 24/7 to me.

If I come to work in the morning, with an important meeting in 15 minutes with my company boss... and find some stupid mong has parked in my space, can I smash the window and roll the car out - without punishment?

Drew - you can say that from where you are... had I been late for that meeting I would have been late to meet important clients and embarrased me boss........... bad bad career move.

Probably not.

I can assure you that if the owner comes back, he's going to have a pretty good guess who did it, and where to find your car. He'll probably mete out some kind of punishment.

Now, the owner of the place you rent from might be able to do something like that, but you won't be on the hook for it.

What you want to do is report it to the lot manager of the moment, and demand they provide you a secure place to park until they sort this bozo out.

No, you should delegate the job to the parking attendant, thus washing your hands clean of any misdoing.

you should ask for parking decal assignment numbers for front or back windshield.

Sue that person instead in court of law.

You cannot smash a car window that is criminal damage but you can legally move the car in case law it has been decided that provided you take reasonable care and do not damage a vehicle you can in this case move it.In the stated case someone used a trolley jack to move the offending vehicle.

If I was paying that much money for a parking space I'd expect the car park to be monitored in a manner so that this cannot happen! I suggest you take it up with the parking attendants/car park owners

if you cause damage you are opening up a can of worms you wont want
best report it as abandoned and get proper authorities to deal with it
they will tow it and fine owner of car and he/she cant escape that as dvla has record of owner

Sadly you can not do that. I do understand your anger. Write a note and place it on the car would be more of a proper way of handling this situation.

It is possible that it was a mistake also. Make sure that the car does not belong to anyone that you know, it would be embarrassing if that car turns out to belong to your boss.

If it happens again and again, well then I might try given in to my anger.

don't do it matey - it's criminal damage and I'd hate to see you get a criminal record and possibly lose your job and your car for an idiot.- if you pay for the space then the car park management need to sort it out - they're quick enough to take your money so make them earn it- if there is cctv then get someone to check it .

Legally no you cant. You would be done for criminal damage.

What you would have to do is get the car park owners to get the car towed away. Its a civil matter so you cant call the police.
And interestingly, if you come home to find a tramp drinking your beer and watching your tv and there is no sign of a break in (ie you left a window open or a door unlocked) then you cant chuck them out without risking being arrested. Legally speaking you would have to go to court to get him evicted at your expense.

You will learn someday that the law doesnt protect the innocent.

No, I doubt that would be a sensible thing to do, but as you pay someone for your space I should report it to them and demand they do something about it.

You always CAN... The question is will the law ALLOW you to do it....

That is why the Jag has a floor jack in the boot. So if a a**h*** pulls this kind of stunt, I just jack up the drive wheels and PULL the offending vehicle out of the spot, then park in MY spot. What happens then is the other blokes lookout....HE has to explain why he got towed for blocking traffic...

Your name really says it all, doesn't it...you must be stupid to think that you can smash someones window and not be punished. You do not get to take the law into your own hands, period. Just cause you paid for a spot doesn't grant you the authority to be a yob. You must call the police, and have the vehicle towed, just like any other person.

Sounds like you would do the owner of the car a favor, and save them the cost of a tow truck. I would think it's less expensive to replace a smashed side window.. If it's legal to do it? Hell yeah! If the owner of the car wonders about that, ask if you need to bring in a lawyer to look at it... Your in your right to do it...

I personally think the same precedence applies here, as in a self defense situation.

Personally if if it was my car and you smashed the windows, then I would break your legs, but hey, I don't drive a car, am not dumb enough to pay big money to park it in rip off car parks. Without punishment? Not if it's anybody I know! You would be punished severely. Legally? Nah! Don't do it.
