Can I sue?

I hired a pet sitter who was supposed to come 4 times a day and only came twice a day. She did take care of my dog, he was fed, watered, etc. but did not give him the agreed upon times. Can I sue her for this?

Please...I think your being a bit extreme. Your animals were taken care of, why you wanted her to come 4x a day is ridiculous to me.Granted she should have followed the directions agreed upon...but to try to SUE HER???? Your getting a bit nuts there.

Sure you could sue, but what would you sue for beyond a refund ? Emotional distress damages are not available in a breach of contract action unless you can show fraud. Also, most jurisdictions consider pets to be property and generally cannot get emotional distress damages for damage to property.

Ask for a partial refund and take the pet sitter to small claims court if you don't the requested refund.

If you had a contract it might be some sort of breach, but other than actual damages I don't know what you'd collect. If the dog had died as a result of negligence that might be a different story.

You can sue anybody for anyhting, but that doesn't necessarily mean you'll win.

You most likely can. But how do you know she only came once or twice per day instead of the agreed upon amounts of time?
If you can sue her, it will most likely be for like breech of contract. And you'll most likely get back a portion of the money. This will probably be handled in like small claims court. To sue her for a huge amount of money probably won't happen as you would have to show like pain and suffering. But you quickest answer will come from an attorney. They do not charge you for initial consultation and they will tell you if you have a case.

You can sue for just about anything, more important is, can you win?

You would have to prove they were supposed to be there 4 times a day, and prove they weren't. They could argue they were there only twice a day, but were there twice as long...

You have a right to get the agreed upon services.

Dogs are only fed twice a day, why did you need her there four times? If you needed her to walk the dog, and she missed two times, and the dog messed on the carpet or now has bladder issues, I guess you could sue for damages. If your dog is just as healthy, what is the point? It sounds like you just talked to the girl, next time write up a contract so you have some grounds in court. Why do you want to sue? What did you lose? Some extra cash you gave her for the attention? If that's the case, ask for your money back.

If you paid her an amount of money for a specific product/service, then I would say yes. It sounds like a small claims case. But have you confronted her about a refund? Sometimes you can work things out without going to court. I wouldn't utilize her service anymore, and would also make a complaint to the Better Business Bureau.

Of course you can. You entered a verbal contract with the sitter and it was violated. It would be even better if you had a writen agreement, but its not necessary. If you paid for the sitter to be there x amount of times and the sitter wasnt you can go to court to recover your losses.

Even in a verbal agreement you can take her to court. You have to file in your local small claims court for any time you may have missed, or any suffering that may have occured because of it.

If you didn't lose any money out of it, you have nothing to bring her to court for.

No not at all, because it will take time and money and till the court verdict, you will have to find replacement as well as new pet sitter will take time to adjust with your pets and this will add to your problems

Sure! If you want to join the other morons that file frivolous lawsuits. Damn people. The lady took care of your dog! Maybe not as much as you wanted her to. But she did it. Cut your losses and never go to the lady again. It's not like you paid her a vast sum of money. If you did then guess what, you got ripped the crap off. I don't understand why people who get mildly annoyed think they deserve a fabulous cash prize. You know how bogged down people like you make the legal system. We could be prosecuting murderers and rapists. Instead, we are listening to you ***** and moan about how some lady didn't give your dog food. In response to your overall question, sure you CAN sue. That doesn't mean that the judge won't laugh you out of the courtroom or that you’ll have a snowball’s chance in hell of recouping the 20 bucks you lost.

Yes, however you will lose more in court costs than this issue is worth. Especially if she was a private contractor. If she was hired through a buisness, you can go through the buisness and get your problem settled through communication and probably get a refund.
