Today I went to food basics and I was walking through the produce area and something got caught around my feet and iwas one of those packaging plastic things that are like a hoop. I fell very hard and my arm is very sore and I am pregnant and I was having a lot of cramping after the fall. I went to the hospital and everything is fine there is nothing substantial wrong. It was very stressful and I looked crazy in the store cause I was crying cause I feared losing my baby due to the stores neglagence. Do I have any grounds to perdue legal action? The manager that I reported the accident with didn't even care he didn't ask if I felt okay or anything.... He wrote my name down with a bit of info and gave me the big managers number. I plan on phoning tommorrow but I don't know what to say to him cause I think I should be compensated in some way or in worst case scenerio I would sue if I have the grounds...

It's my fault that the workers didn't do their job properly? They left a white band on a white floor. So because I didn't get. Hurt badly it's my fault I never knew I had to be so cautious in a grocery store....now if I fell down stairs or slipped on a water spill that was clearly marked it would be my fault but this situation shows pure neglagence

Well it's really up to you and your sense of right and wrong and morals and ethics. Personally, if everything is fine (continuing up to the birth of the child), I would thank my lucky stars (Thank GOD) and then go on with my life, being more careful to watch my feet and where I was walking (especially through the rest of the pregnancy).
If you believe in GOD, GOD is always watching. Do you think HE wants you to sue or let it go if everything is fine? Sometimes we have good experiences in life, sometimes we have bad experiences.
I wouldn't exactly say it was definitely the store's negligence. Maybe some inconsiderate customer caused the thing that made you trip and the store's employees hadn't seen it yet to remove it from the floor? Do you know how that "packaging plastic thing" got to the ground? It should also have some bearing on whether you decide to sue or not. |

You'd have to prove that they were aware of the hazard and failed to act on it to have a valid claim. That said, requesting they cover any out of pocket medical expenses would be reasonable and probably granted in return for a waiver of suit. |

You can't sue because you weren't looking where you were going....
To sue, there has to be two things "damages" and "fault". You may have damages in medical bills, but you would have to prove that it was the store's FAULT that the bag was there. And, unless they put it there to trip you up, good luck with that.
