Can I sue my professor if I can prove she's trying to fail me?!?

Can I sue my professor if I can prove she's trying to fail me?!?

Additional Details
To elaborate, my professor GAVE me a 69 on our midterm (which she first stated, "I deserved"), which she later "realized" after I had to hunt her down to go over my test, that I actually didn't miss the 5/7 "multiple choice" questions, which she had marked wrong. Therefore, she changed my grade to a B. I asked why not an A? She told me that 10 pts was as high as she can go. I told the chairman. He informed me to wait and see what she could come up with, by the next class period. (This is 3 weeks after midterms).
I'm still waiting...

Sue yourself because it is you who are failing yourself.

You can sue anybody for anything; doesn't necessarily mean you will win, though.

Well DUH!
If you have proof---and it better be some really good proof for this issue---then yes, you can. If you don't have good proof, then the judge will just laugh at you and call you a fool and say that you were a waste of his/her's time!

Sheena
if you have enough evidence and such, you can talk to the dean

You can sue, but unless you can provide the court with proof that your professor is holding you to a higher standard than they use for the rest of the class you will not prevail in your suit.

lhaha892
Be more specific. Yes, you probably could.

Zac
Start by speaking with the dean of student affairs. You should be able to let them know the problem and also be forceful in your conversation, tell them you are seeking legal council. The chances are that they will try to resolve the problem by moving you to another course or helping with your grade. This will save you the money of actually trying to sue on a case you might not win.

Yes you deff can, but i'd get some other (experienced) professor to check over all of your work to make sure that she is actually failing you, and details please!

you probably won't win if ur failing tests and ****

Maybe your professor is not trying to fail you. Maybe you are in a class that is to hard for you. But I guess if she really is, but I doubt she is, I think you can try and talk to the people at your school that run things and ask for their opinon and then you will probably solve your problem that way.

definitely. all contingent on the assumption you can indeed prove this. good luck.

Get evidince before you try to lock up an adult with full world experiance.

If you're sure, I don't think so, but you can kick them out of the school.

Depends if your evidence is strong enough for the lawyer to consider.
How can you prove it? Can you add it in the details?

you cant sue your professor for failing you. They decide what grade to give every person, and would probably end up winning in court every time.

You could report that professor to the dean of your university, and see if you can get something done about it.

This is all assuming you do have proof.

Codemon09
fail!

You could if you can prove that she is actively trying to fail you. The only REAL proof that could leave an open and shut case is if you record her saying that she is purposely failing you and that she knows you're not failing. Other than impossible evidence like that, It's rather hard to prove. Generally, schools know how to cover their own *** to prevent these kinds of legal cases, since you technically wouldn't be suing her personally, but professionally, meaning the school would have to pay the damages.

You need to contact the deans offices first and bring all evidence. If the office decides that your professor is failing you purposely, they will take the actions. If the dean's office won't be able to help, then you most definitely can take proofs into court.

Yeah you can sue the teacher for self defense. I think I am approaching the same situation. I have had teachers that personally have not liked me, however I have this teacher that I have for political science, at my college, I think may be failing me on purpose. I am trying to figure it out. He has neglected to return my work back to me, however everyone else seems to have that assignment back. I think if I don't get answers soon a lawsuit is all that will clear up the conflict.
