Can I take a neighbor to court and sue them because the let their dog constantly do their business on my yard?

I have no idea who is doing this. It just started about six (6) weeks ago, I think If I get a camera I might be able to stop them from doing this. The dog do is always in the same area of my yard. I just want them to stop it.

1st: Don't do the pellet gun thing because depending on where you live, that could screw you over.
2nd: If you sue them what kind of damages do you expect to get? a dollar? Why not try talking to them first?
you: "Hey please stop this it is pissing me off?"
them: "ok no problem, sorry."
Could also be a stray (which means just call animal control) as in my experience dogs like to go in the same spot if they can, someone who is walking their dog is unlikely to have it go in the same spot every time as the odds of the need being there every time the dog walks by is unlikely.

i KNOW IT MAY BE HARD TO DO BUT TRY TO CATCH THE DOG IN THE ACT AND SNAP A PICTURE OR A VIDEO OF THE ANIMAL IN ACTION THIS IS THE SUREFIRE WAY TO PRESENT THIS CASE IN COURT.
