My nephew has legal guardians (grandparents) but he doesn't want to live with them (long story). He doesn't like living with his mother and her boyfriend. His mother doesn't want to be a mother anymore either. Mother and boyfriend are moving. He would rather live with his Aunt. Is he old enough for this and for no one to get into any trouble by DSS? This is for the state of SC.

If legal permission is given by his legal guardians than there should not be an issue, I believe all they would have to do is sign custody over to the Aunt. |

As long as ALL the Parent(s) & Legal Guardian(s) agree, I don't see a problem. |

There are al;ready legal guardians, I suspect given by the court.
A parent may do something about custody, but I find it hard to believe that is legal guardians can, unless they go back to court. I think a parent might be able to give permission, however as a guardian is involved, they can't. And neither can the guardians if they have guardianship under a probate or family court.
I suspect this may turn into a Petition of Neglect or a JD petition.
As much as I empathize with his predicament, 16 year olds do NOT get to pick who they can live with!
Unfortunately, many have poor parents who should be the ones being held accountable.
I have always had an issue with throw away children. And people wonder how they get so screwed up. Well, they are not born that way.
Hope for you the best but be careful to do it legally and make sure you are not being manipulated! Kid's learn that at a real early age! |
