so like im with my friend, and she was raped when she was 5 by her mothers neighbors son, who was 13 at the time. since the offender was that young, is it still considered rape? and does the age matter at all ? complete answers please.

we also have no evidence that the rape took place. only her memories, and possibly his. we're not sure if he remembers though. he was described as the type of person that, "shoved bad experiences to the back of his mind, where he forced himself to forget". he was kind of a messed up kid, i knew him. but my friend is sitting here crying, she wants to do something about this all. but we're not sure how.

Yes it still constitutes as rape. However, it may be too late to press charges, depending on how old your friend is now. In most (if not all) states, there is a statue of limitations on rape. (Meaning you can't press charges, or arrest someone for rape after the time limit has passed). |

It is considered rape. A 5 year old could not in any way shape or form give any consent to that. |

Yes the offender can be charged with rape; it will be up to the D.A. to determine if the offender can be charged as an adult or as a juvenile offender, but still he can be charged.
It's not too late to file charges; the statute of limitation starts runing once she turns 18, OR in some jurisdcitions there is no statute of limitation when the victim is a child.
But ofcourse the longer she waits the harder it will be to prove, but even if she lose at least he will be exposed as the pervert he is. |
