As yet another part of my pregnant 16 year old friends saga, she wants to know (as do I) if she can give the baby the father's last name even if he doesn't not sign the birth certificate (he can't, because he would be arrested), without them realizing that the name is actually the fathers? Like, say the father was Joe Smith, and he didn't sign the birth certificate so she named the baby Jim Smith, would they investigate, and automatically assume that the father is Smith? And if she doesn't like the father's last name at all, can she make it something completely different? I've read through the answers other people got on this question, and there were differing opinions and some said it varied state to state, so all three of us would LOVE a concrete answer!
(ps. Please no OMFG she's pregnant by an older guy, he should be in jail!!1!! comments. They both know it was a bad idea, but her and I both think he's a great guy for stepping up to the plate and trying to do the right thing. Thank you!)
