Can a condo ban smoking in your unit?

There was a case like this in Boston. The people were heavy smokers and it kept going into another person's unit. THey lost in court and had to leave their condo.

I am not sure, since that is your private space, especially if you own it. If you rent, you might have less rights. They might be able to restrict it if the smell enters common areas.

depend on the contract you sign when you brought the condo....in my neighborhood, if i don't cut the grass, someone will cut it for me and bill me later...if i don't pay, they take me to court. And, because of my contract, The judge will force me to pay.

They can try... but when it comes down to it, you own the property, they don't. When the court cases are all done, I think it depends if your courts are blatantly activist liberals or not.

If you own the unit, certainly not. However, if you are renting, it is still their property and they obviously don't want the smell of smoke lingering in there long after you leave.

The number of municipalities, employers, federal government, and who know who else, are constantly trying to ban smoking somewhere. There is even talk of trying to ban smoking in the privacy of your own home.

They can and will. If it bothers the other tenants or causes damage to the property (ashes/embers burning carpeting and other things)

Oh yeah, they usually can.
When you bough the property you PROBABLY signed the contract to enter the "condo association", the contract PROBABLY included the procedure for the rule change, usually by vote of the members. By agreeing to the procedure you agreed to the rules that the procedure can generate.
So read you contract, maybe i am wrong and the condo association got sloppy, and there can be loopholes.

I will not tolerate any smoking ban, I smoke when I want, they have to catch you with it in your hand. have you ever smelled smoke in a non-smoking room?

Beth is correct; if you own it, do whatever you want. If you rent it, they can prevent you from smoking in your condo. Usually it's an insurance matter.

Housing Authorities can do basically anything they want.
They prevent my friend from clipping a tree that scratches any car going through that driveway. It is b.s. but i am pretty sure they can do anything
