Can a cop search my car if he smells pot?

Most of the time. It depends on who you may be related to. One of the cops in my family stopped a kid for speeding. When he had the kid out of the car (sobriety testing) he noticed that there were small pot plants growing out of the pad under the floor mats where rain had leaked in. The kid turned out to be related to a judge and walked while my brother in law got an ash-chewing.

Sure... If, let's say, you had a headlight out and a cop pulls you over and notices there's a scent of alcohol, that constitutes a reasonable suspicion justifying an investigation. You have no privacy rights while in public.

yes. just like if they smell alcohol they can make you blow or check the search the vehicle. even if they are suspicious of any mishap they have the right to search you.

Laws vary from state to state but where I live they can about use any reason to search anything anymore. Yes smelling pot would be within reason too. Tinted windows do it here because they can't visually see who or what might be lurking in the car.

Yes he can if he actually smells pot. By the way, it smells similar to a burning rope, not like a cigarette.

The issue I have is that he can say he smells pot (so that he can search your car), even when there is no way possible that pot was present.

A good way to prevent this is to have you and your friends riding in the car eat a large portion of beans and just before you get pulled over everyone start letting out some good sized farts which will serve to disguise the smell of pot and therefore no search. In fact after smelling everyone farts he just might be willing to let everyone get out of there asap...

lol yes it is probable cause. He can't "search you" but he can pat you down for his protection. And if I tell someone a dog is en route..... you better believe his nose is going to be burred in your @$$. And these aren't just state laws. They are all covered by supreme court decisions, which make them applicable in all 50 states.

In my state that's probable cause and they can search the car.
The only thing they can't search is the people...unless they find something in the car to indicate they could have something on their persons.

that's why you always go with the windows down. Yes if he smells a lot. But he can not have you open a locked container (like the trunk) without a warrant. Also, always say you do not consent to a search loud and clear regardless if he says he can. If he finds nothing, then you can sue the crap out off him.

The answer is actually no. Humans don't have a reliable sense of smell thats why they have K9 Units - you can check out NORML's website for better information. Even a K9 unit only detects substances 30% of the time. Simply get out of your car and lock your door. They have no reason to suspect anything if they can't get in, can't see and can't smell what's inside. They also have no right to have you unlock the door if they do so forcefully they're trespassing. All evidence obtained should be forfeited in court with the right attorney.
