PLEASE ANYONE WITH A RELATED SITUATION ANY IMPUT WILL RELIEVE THE STRESS!!! So I will be giving birth to my 1st child in a few weeks. The father has not been in the picture and he recently received child support papers in the mail notifying him that I will be filing child support against him. He made a phone call to me about a month ago and said he had doubts he is the father and will request a paternity test to be taken. This was about one month ago and I have not heard anything since. Well...today, he called me and began making threats that he is going to get an attorney to try and get custody?! This is his background: He has a criminal history involving public intoxication charges, assault on a peace office twice, and domestic violence in his previous relationship. He recently got off probation in December. He was living 6 hours away from me and recently moved to my town for no reason. He does not have a support system in place. And he is currently living in a motel. Will this be enough to ask for supervised visitation? I know the standard is every other weekend, but this is a serious risk issue for my child! Im really scared and thinking of just dropping the child support order if he is going to try and take her. Is anybody out there who has a NCP getting supervised visits and if so what was the reason for them? I want to make sure he wont be able to take her! Please help :(

My son's father has supervised visitation, but that is only because I obtained a restraining order on him for domestic violence. His father has a criminal history as well. I'm not sure if they will make his visits supervised because he has to be seen as a danger to the child. Since there are no reports of domestic violence between the 2 of you, he will likely get regular supervision unsupervised.
However, he will NOT likely try to get custody. He has a criminal record and the only way he could get custody is he would have to prove that you are unfit and a danger to the child.
Even then, with his criminal record, the chances of him getting custody are zero to none. As far as child support, I think you should pursue it. You didn't make this child on your own, he has the responsibility of caring for the child as well. Don't let him get away with not paying. If he doesn't pay, oh well, at least you know you tried. You can continue to provide for your child and leave that between him, the child, and God. Good luck. |
