Depends where you live and how the DUI law is worded.
If the law makes it illegal to drive a motorized vehicle, then riding a bicycle is not a DUI. If the law said operating a wheeled vehicle, then it is a DUI.
Years ago, my partner and I tagged a DUI on a riding lawn mower.
Some states covered all bets by making it illegal to operate any "conveyance" while intoxicated. So, you can't ride your horse either. |

no, i had a friend that got a DUI while riding a bike after drinking a couple of years ago. no joke! |

Nope It's a moving vehicle.
Actually, most cities have public intoxication laws and your really not even supposed to WALK home if your dunk!
I used to work for Public safety in college. Most of the officers left people alone tho as long as they didn't cause any problems or got too loud. They would much rather see them walking home than driving drunk! |

no, they may not be charged with a dui, however they can be charged with public intoxication.
They would also pose a threat to motorists if they were riding their bike in the street, especially at night. |

No. The problem is that it's a vehicle and they can get the person for DUI. I don't imagine it would be a problem if it were pushed, because I don't see how they could charge anything other than public intoxication. |

<>If you are drunk and on the road, you are DUI (DWI) and a menace to yourself and/or others. |

Yes you can. I was sober and had my bike in UCSB a while back. My friend was drunk and I decided to take him home rather than go with the others to a party at a frat. He decided to take my bike and bike haome with me at the back. I argued with him. Finally the police found us and threaten him to give him a DUi if he didn' get off the bike. It took 15 minutes of arguing before he did. 15 minutes latter I got into the same arguement and finally gave in. He hit a white surf board! TOld me how in the heck he expected to see something like that on the road. |

A lot depends on the laws in your city and also, how big of a weinie the cop that pulls you over is.
I've heard of some hotshot cops trying to tie drunk bicycling in with public drunkeness.
Your best bet is to drink at home and don't do anything in America that will displease the government.
Our "free" country has more prisons than any other country in the world and a higher percentage of the population incarcerated. This figure includes dictatorships and socall terrorist run countries.
My question is... if the American government is so deadset on arresting us, how can we call ourselves free? |
