Can a fathers parental rights be removed

my 14 month old old son hasnt seen his father in almost a year and hasnt payed a penny towards him. he takes drugs and drinks most weekends and can be violent

He already is not making use of his parental rights. What parental rights are is the right to be involved in the up bringing of the child of religion, school, morals etc. He is currently not invoking his rights to be involved thus it would be easier to get a court to take them away. The other fact of his personal choices in life also helps but you can not just go in saying these things you actually have to have proof. If you can not prove he is using drugs it could hurt your credibility and work against you. When parent’s rights have been removed they are still financially responsible for the cost of raising their child. To get child support you have to get a court order and also have it so that the family responsibility office or something of that sort is responsible for getting his employer to deduct it off of his pay check. He can also loose his drivers licence and be sent to jail for not paying child support. Child support and Access to a child are t0 separate legal issues and a parent is not aloud to say I am not seeing my child so therefore I do not have to pay for my child. Also the same is true in reverse a parent is not aloud to say I am not receiving child support so I am not allowing him to see my child. It is all about what is in the best interest of the child. Even if he is on drugs and drinking they still might give him supervised access. It is all up to the courts.

If he is the father and he hasn't payed you can make him pay by law or get him sent to jail as he hasn't payed and that will get him out of the way. He can actually go to jail though. This is in England though not sure about anywhere else.

Child support isn't connected to visitation. You can ask him to sign a paper releasing his rights if you have someone willing to take on his support. If you can take away his rights because of danger to the child he won't have to pay support anymore. If the money isn't the issue get a lawyer and get the courts to protect your son.

I am wondering why you chose to have a child with a drunken violent drug addict. You need to take responsibility for your own actions.

MickT - sometimes the person becomes like that over the period of the relationship and usually rear's it's ugly head while the woman is pregnant. Any more help full advice?
JadeT - If he is having nothing to do with you and your child why do you need to have his PR removed? You have good ground's if you really want to go that way but it's a very lengthy process ( recently spoke with my solicitor about same issue's)

Only the father can remove his parental rights. If he is not paying child support, then you need to take him to court so they can order him to pay.
