My 10 year old son was picking on a boy and caused the boy to wet his pants in front of his classmates. I spoke to my son about bullying and I know he won't do it again. We apologized but the mother of the boy who wet his pants is taking us to court. She's demanding money and not only that, but she wants my son to wear diapers to school for a month. I guess they think that punishment fits the crime or something. Is it possible that the judge will go along with that? I know judges do strange things, but it doesn't seem right. It seems vengeful.

What the parent is talking about is a civil suit for damages; No civil court judge has the authority to order an older child to wear a diaper as punishment i.e. humiliation, so she is plain nuts on that
Next that said in order to sue in civil court one needs to show damages, so what are the damages? Dry cleaning the pants? Emotional distress? Better bring third part doctors reports and even if that the court will take into the age

I think punishing a 10 year old boy to wear diapers to school would do no good, and a good judge would know that. So, the answer is no. |

No, I highly doubt the judge would ever agree to something like that. If the judge even agrees for a punishment, it will be a fine or mandatory counselling against bullying but there is no way the judge would agree to humiliate your son like that. If I were you I wouldn't worry too much. |
