There are no guarantees. Many legitimate cases lose in a court room, and some not so legit ones win.
Unless you have an agreement for him to strictly take a percentage of the award, you can be billed for his time. |

Why of course.
If he agrees to take it on as a contingency, then his payout is based on a favorable award to you. The per-cent in this type of contract can be pretty hefty however. |

Of course he can. Telling you you have a legitimate case is not at all the same as guaranteeing you will win...a lawyer can never guarantee what a judge or jury is going to do. If he lost the case because of some mistake he made or something he did wrong, then you may be able to sue him for legal malpractice, but just because the case was lost does not mean he's guilty of malpractice and does not relieve you of the responsibility of paying him. Even if he had taken the case on contingency, you wouldn't have owed him any legal fees if the case was lost, but there probably still would have been some out-of-pocket expenses you would owe. |

Yes. All litigation has risks, a legit case doesn't guarantee a big win. Other information may have emerged after they told you your case was good. |
