A friend of mine claims his wages were garnished for child support after he was released from the Army. He had lost one leg in combat and along with other conditions to cause him to be released under combat related disability. Years later he owes over $22,000 for child support directed at the time period he was 1) in combat, 2) in the hospital 3) released from service with a Prosthetic below the knee. He has been unable to gain employment since his discharge. His bank account which contains his disability check may be garnished AGAIN, as per a letter received from the office of the Director County of Los Angeles, Child Support Services Department dated June 30, 2008.
Do you think this is the respectful way to treat the American soldier who lost a leg in combat and who could not pay because of it?
My question is: is there a law that protects the disabled Veteran from this type of abuse?
Please let me know if someone can assist.

A lot of people seem to have a disgraceful attitude about this subject.
"A soldier's child needs support, whether the soldier is dead or not." Heh. And where is this support going to come from?
Why are people so darn quick to insist that someone else do what is impossible? That's nothing but bombast, pure self-righteous moral grandstanding. "Oh look see how good I am to insist that someone else do what is right, even if it is impossible."
In my opinion, anyone who says that a soldier, injured in his country's defense so that he cannot work, should pay child support nonetheless, that person should be required to pay the soldier's back support personally. Children must be supported, you know. So grab one of these slimy liberals and make HIM do the supporting! For example, I think that "Justbeingher" should have to pay this fellow's child support, since he is too injured to do so and... the child MUST be supported!
Another thing you might try: switch custody from the parent who is not injured (and who can, presumably, still work) to the parent who is injured too badly to work. How about that, liberals? Good idea, yes? |

they would do that to ANY father. It is the way the system works. Usually if you have no income they set the amount at a minimum/token sum of about $25 per week. That is if you have a good reason for having no income. But you must initiate the reduction in court. Having a lawyer is always a good idea. |

Unfortunately, the fact that he fathered a child supersedes the fact he was injured. Government issued wages fall under different federal laws than civilian wages issued in the private sector.
It does not seem fair, but the child is more helpless and less able to provide for itself than the injured father. The responsibility of being a father in this case should not be personalized as "abuse". Legal appeal can and should be made for the child to be provided federal benefits on the injured's behalf.
If he has a prosthetic limb, then he has more ability than many other handicapped persons to secure employment and defray his debt of responsibility for child support. |

Children need support. Injuries or not. Disability should be paid to the child also if the parent recieves it. Go to SSA.GOV for more information. |

You are not exempt from payment at all. It is not abuse he has failed in his responsibilities to his child.
If his ex has remarried or has a good income. he may be able to show cause why he shouldn't pay as much, but thats about all.
He stuffed up, and the law has caught up with him. |

Yes,he is responsible for all child support owed, if he has any money they will get it one way or another. |

Childrens needs trump adult needs, they are innocent, they did not ask to be brought into the world.
The child needs to be taken care of. If he is injured and can not work, he is eligible for social security disability, and his dependents are eligible as well.
I would ask that is this the respectful way to treat an Amercan child with a father that can still support him? |

Regardless of whether or not he is a soldier/hero he still has an obligation to his children. I see no point in comparing the two. Yes it is awful the situation he is in but another question would be is respectful to ignore your children? |

He should contact a lawyer, to see what his options are. But he maybe required to pay for this time. I don't mean to come off as rude but respect or abuse has nothing to with a child being taken care of by BOTH parents. The child has to be taken care of regardless of mom or dad's situation.
I do question the reason he failed to pay support while in combat. The reason I ask this is because I have had several relatives, including my husband, in combat. And they either took care of matters before they left or had someone here to make certain decisions, in their place. Plus, there was the option to set up automatic payment during his tour and hospital stay. Those who are wounded would continue to get their pay while in the hospital. So I'm having a hard time seeing why he could not pay support while in combat and in the hospital.
If his income had been reduced, he should have either contacted the state or sought help pertaining to this matter, so they could reduce the amount of support to fit his current income. |

Yes it can be done.The child did not stop having needs because of his injuries,and disability.I know a guy who's disability check is being garnished for a child who is 31 yrs old.He had an injunction to pay $7,000.00 back.He payed that and got a letter stating it was paid.They still took more he contacted the state of Alaska (the home state) that it was paid off they said come up here and get the judge to stop it....oh by the way if you come up here there is a warrant for your arrest for non payment of child support so they are STILL taking over $500.00 a month out of his check to the point that he can't even afford food.If someone else knows a way to stop it I'd like to know!! He can't afford an attorney as it would have to be someone in his state that he lives whoi s licenced to practice in Alaska...and he can't afford it~ now we know why our vets are homeless |
