Can an employer change u from hourly to salary?

my husbands boss has just told him he will be changing from the hourly pay per hour he works to a salary per week,this is going to drop our income a great deal,if contracted to be paid per hour worked can his boss just change it like that?

If what you say is true and that he was "contracted to be paid per hour worked", no, the employer can't do this, but most states are employment at will, so then CAN just fire him.

US is at will employment. Unless he is under contract for a higher rate or has a union pay protection, it's legal as long as he is not making less than minimum wage and gets the hourly set up of a salaried employee.

Yes, they can. Companies around the world are making cutbacks. Be glad your husband didn't go from hourly to zero and he still has a job.

Not unless he meests the requirements under the Fair Labor Standards Act.

He would have to reclassify the job as exempt and most jobs can't be classified as exempt. Exempt positions are mostly upper management or seasonal employees. Contact the Department of Labor if you think that is not the case.

I had this issue with an employer. At that time the Fed. Govt. regs. said I could only be on salary if I supervised 3 or more people, which I didn't. So I won.

Check the guidelines referred to in another answer.

There are a lot of factors involved. Was there a written contract (usually not with hourly employees)? Do you live in an at will employment state? What are the state labor laws dealing with this?

Generally, the employer does have that option to change the terms of employment unless bound by a written contract. Your husband has the option to find a new employer.
