As long as you can use some other means to substantiate your presence for the day, they will be required to pay you.

However, nothing prevents them from firing you for failure to follow company procedures.

It will basically come down to you deciding how far you want to push it against how far you think they will go if you do.

Does it state that in your contract? Is there an employee handbook that covers the penalty for not clocking out?

You worked, you get paid for time worked. It is because some people fail to clock properly that we have a redundant (usually hand-written by a supervisor) record of hours worked.

Your employer must pay you for hours worked. He can, however, sanction you with fines and disciplinary procedures if you fail to follow time-clock policy.

unfortunatly they can because otherwise they would have to pay you till you next log in and the other side of it is if you dont punch out how do they know if you have been there all day
