Can i be sued for making a deragatory remark about someone to a friend?

I made a remark to a friend about someone he works with and was not aware he had quit and the person I was talking about heard his voicemail about what I had said about him. Now he claims he cant work and have caused mental harm and all I said was he was ****Dumbass!! I live in Los Angeles Ca. even though I didnt say it to his face can I be sued?

You can be sued for anything which means that you can counter-sue for anything. Keep in mind that HE QUIT making himself look bad to those hiring. Also, it was unintentional. You didn't know, nor were you trying to cause damages. Say that you didn't know but he is intentionally making threats and causing emotional distress (just don't lie as you will be asked for proof). Try intentional infliction of emotional distress. Oh, and yes he is a dumbass but you can still beat him at his own game.

People can sue people for anything. The issue, is whether he will be laughed out of court, and I would think so. He can't successfully sue you for your opinions. And he can't sue you for emotional distress just because you called him a name. You didn't even call it to his face, so he a.) is a total wimp, and b.) has no cause of action. But just be careful in the future. If you can't say something nice, don't say anything at all. It's cliche but you always want to be mindful of the reputation you make for yourself. Kindness and integrity will get you much farther in life than being rude, and caddy.

no that isn't even harassment, i took a class on office harassment and you have to do something like that several times, just use better judgment in the future.

This guy is being ridiculous - you have just shared your opinion of him with someone else - big deal, we all do it on a daily basis. What will he sue you for - slander? Don't think so. It's no like you've spread out some nasty rumour about him all over the work place, or said something to impair him professionally or mentally. It's all BS, guy's just being Dumb.

In theory, yes. Any false statement that is published to other people in a transitory medium (like speech) is considered slander. In practice, unless he was able to prove that the harm he suffered was directly caused by your statement, it wouldn't hold up in court.

You can be sued for loss you cause. His mental breakdown was not caused by you. You would have to say something untrue, that got him fired, to be liable. You could also damage his reputation as a business, but statement would have to be untrue. He can sue you but he will not win, unless you damaged his income with lies. Not working over emotional breakdown is his fault, not yours.

He can sue you for slander, but he'd have a tough time proving that economic damage was the result of your statement.

If I'm following this correctly....you called someone your friend worked with a name and now your friend is claiming you caused mental harm? If that's correct then your friend is no friend. I wouldn't have ever used that type of language on any voice mail because you never know who is listening in at someone's work. Most emails are also monitored by company mail systems as well as internet activity. Anyway, if it's your friend threatening to sue then he can try, yes. But he's pretty much going to have to have a witness willing to testify about what happened in order to get anywhere. If it's the guy that you were talking about, then you have a problem because he has the voice mail.

he can try now days you can get sued for looking sideways at a fat women but he wont get very far what you say to your friend on a voice mail is your privacy if he heard it then counter sue his *** for invasion of privacy but dont start mobing him or he can get you for harrasment
