Im 15, andf my mum's boyfriend has started threatening me, not directly but to my mother. and she of course has been defending him and stuff. i'm scraed to be around him and my mum wont listen to me. id like to put a restraining order on him, but i think because im under 18 i need a parent to do it for me and i know for certain my mum wont do it and i dont think my dad will think its a good idea since my mum's boyfriend hasnt actually done anything to me. Is there any way i can get a restraining order on him?

It is difficult. Yes, you will need a parent or a guardian. You say that your mother's boyfriend didn't actually do anything to you. Even though he threatened you, you cannot prove it because he didn't do it directly and your mother disagrees. I don't think you can put a restraining order on him. If you are right about your worries, the most logical way would be convincing your father. |

Tell your Dad what is going on and do not assume he will tell you not to worry about it. He may very well let mum and BF know that his little girl is not up to being terrified.
But if Dad won't step up and defend you, then call local Children's services or the police and ask them the same question. |

You can contacts CHS (Child Services) if you think that he is a threat to you and your mother is not doing anything about it. |

Yes and I don't know that you have to have a parent do it for you. But if you do and if your father won't do it you can go to the court and ask the judge to appoint a "guardian ad litem" to do it on your behalf.
And you can make a report to Child Protective Services as well, and I think you should; they can take you out of the household and tell your mother she can't get you back until the BF is gone. They'll put you with your dad.
If he has made threats that he "could" actually carry out that is legally an assault and if he has done it more than once that's normally all it takes to get an order in most states. And you need to tell your dad to take it seriously, he doesn't have to actually attack you! |
