I think I would get something stronger than a paintball gun. That is just gonna piss him off even more. |

if you are in texas you can kill him in defense of you home or family.
its called the castle doctrine |

I'd avoid a paintball as that could get you in trouble. Maybe a restraining order would work better. |

short answer: nope
longer answer: nope, depending on the state you can be slapped with a range of charges from public nuisance to assault |

Yes, but it may only escalate the situation. |

Inflicting bodily harm is never a good idea. The police don't look too kindly on violence no matter what the reason. Throw water balloons at em' or get a water hose. |

Get a restraining order. Legal and then he can be arrested. Don't take a chance that you wont get in trouble because it is a paintball gun. What if you put an eye out? (lol) |
|

|
no because then he could charge you for mis-use of a firearm, assault, etc. why don't you get a police report made out and then the next time he does it you can have him arrested and prosecuted for trespassing. there is a right way to do it and a wrong way...these people who say use the paint ball gun are telling you the wrong way....be smart! |

shooting him will be give him reason to defend himself, thus he will be able to claim self defense while you can be charged with assault.
My suggestion would be to get a self-defense weapon (pepper spray, taser gun, something like that) and don't approach him, tell him to get the #$%$ off your property, and before you confront him, call the police and maybe even consider filing a restraining order.
Good luck, cheers ^ ^ |

YA is a sham

In most states you are allowed to defend yourself using non-lethal force if threatened, and lethal force if you face imminent physical harm, especially on your own property.
If already being threatened, a paintball gun may only incite him further Get a restraining order and shoot him with a video camera if he continues to threaten you. |
|

No, with out the threat of deadly force you would be charged with assault. You continually call the cops, as tresspassing requires the person to be ask to leave and if refuses then the COPS can forceable take him to jail! |

yes it would be nice, yet he could the probably sue u or something. Unless you feel like your life is in danger and you have no way out of the situation maybe. but if he is unarmed just lock the door and call the cops. |

If he is threatening you, then yes, in most states. Check your state's laws. |

Dan,
Do NOT shoot your neighbor with a paintball gun. Your neighbor could hire a good defense attorney that could misconstrue the whole paintball thing. They could say that your neighbor "thought it was a real gun", and you can only imagine where that will go...
If your neighbor wants to use violence, make it known to him verbally (and preferably with witnesses around) that if he attempts any violent act on you, your family members, or tries to damage any of your property, you will immediately call the police. He may act like a toughguy, saying that this doesn't scare him, but no one likes misdemeanor/felony battery charges, excessive legal fees, jail time, criminal trespass to property charges, and who knows what else...
If he still wants to fight, he is stupid. He needs to think about the consequences of his actions...Good luck! |

what state are you in? |

I'm sure you could, but don't - you don't know what he is capable of doing. Keep calling the police! |

Only if you want to get arrested for assault. Depending on the muzzle velocity of the paintball gun, you can be charged with assault with a deadly weapon, or aggravated assault. This could land you in jail for 6 months.
He's trespassing, as long as he doesn't touch you you can't claim "self-defense". You have the option of staying inside with your door locked, and calling 911. (that's just the way it works, I'm not saying it's right).
Is it worth the risk? Only you can decide. |

haha i would or get a restraining order |

Yes, if the police haven't been able to stop him then take it in your own hands. |

You need good proof though, just make sure you can back it up cause some neighbors are liars. |

If my neighbor shot me with a paint ball gun trust me there would be a fight on our hands. Not a good way to calm things down. |

Yurok Warrior

i think that would just piss him off more and cause real problems. Maybe you should just go for it thow down with him kick his *** and he will not bother you again if you mess him up good. |

You have the right to protect yourself on your property. If he were causing trouble you bet. Hopefully you have a good paintball gun! |
|

Calvin T
|
just call the cops...who knows, u could get in trouble with the paintball gun. |
|

brEEZYfeen
|
Yeah, as long as he doesn't see you...
If he see's you, he will know you did it in purpose and
will continue on tresspassing on your property wanting to
start a fight even more.
As long as you don't really injure him badly in any way.
You could have restraining order against him though;
that would be more acceptable.
But if you want to go through with the paintball plan,
you can as long as he doesn't see you.
It would probably bug him so he wouldn't want to come back
at that haunted property haha. (Well to him it may seem
haunted or something)
WELL GOOD LUCK! :) |
