I don't believe you have the legal right to collect unemployment if you are a IC.

You can continue to collect unemployment while working. But, you will need to declare all income on the form that arrives with your unemployment check.

Failure to report that income is a felony in most states, and may result in criminal prosecution and forfeiture of your right to continue on unemployment.

Some portions of wages earned while receiving benefits are exempt. Your States Unemployment office can advise you.

It doesn't matter, your still required to report any income/earned wages while receiving unemployment.

Depending on the amount you earn, it may be deducted from your benefits.
