Can i sue my ex for wrecking my car?

My ex was in an accident with my car almost a year ago (July 08). He has been promising to fix it. I have even broke down and bought the parts needed. He has not fixed it yet. I am still paying for this car so i cant give up on it. I don't have the money to get it fixed myself. Is it too late to try to seek legal help in getting this matter resolved?

Get your ex to admit by email or other means he is liable for the accident, or a police report should be enough, then go and get three estimates to repair the car, then sue the ex in small claims for the monies |

You can take it to court. Also because you waited it shows he really is not going to do anything. |

If you still owe on the car, you are required to have full coverage insurance. Have your insurance company fix it and sue your ex. |

If the damages are under 5000 then you can take him to small claims court and you will not need a lawyer. Before you do try to get him to state that he is responsible for the damages and that he will help you with the repairs. Get him to admit to this in a phone conversation or an email. Either way he damaged your property and he needs to rectify the inequity. |
