I moved into an apartment with a girl, from an ad on craigslist, March 1st. We both signed a contract between US that the lease would be for 9months. I paid first and last months rent prior to move in date. I stayed all of march and half of april, and payed for the month of april.
The first few weeks were ok, we got along very well. Then all of a sudden, she got a little too comfortable, and started judging my friends, that she never even met...saying they steal, and they're ghetto, so on and so on. So i confronted her one day, and told her i don't think this is going to make us become close, like she wants us to be, and she went OFF!!
The next few days, she was walking around the house, taking toilet paper from the bathroom, hiding dishes, and sending me threatening txt msgs. One day she decides we should have a talk about us living together. She gave me a choice of if i want to leave now, or stay the remainder of our lease. I told her, it's up to the BOTH of us...if she feels like she can stay living w/ me for the remainder of 9months, then i'll stay, if not, I'll leave JUNE 1st...so i could stay for the LAST MONTHS RENT that i paid. She said NO!! i would have to leave at the end of April bc she doesnt wanna be bothered with me.
So later on that night, she says she'll give me half of what i paid for april, since its the middle of april if i leave NOW... she comes in my room, and TRASHES the room, tells me its HER house, she does wat she wants. She kicks something at me, then chokes me. I hit her back, and put a little brusie on her face, and she calls the cops and has me arrested.
I want to know, if i can take her to small claims for last months rent, and the 300$ for half of april that i didnt stay there for...

i mean...i had to leave bc she has an order of protection against me..so i cant be anywhere around her..so i was FORCED to leave ASAP

What are you going to sue her for? $600 bucks? You need a lawyer and they'll charge you around $200 an hour just to file paperwork.
She might kill you in your sleep. It sounds like she's psycho.
Just take your stuff and get out of there, dude. Once you're out you can try small claims court. |

You can. Find evidence and don't make stupid mistakes such as citing what may or may not have happened. Word of mouth is terrible to play by in court. You can try though. |
