we're students and we rented a house through an estate agent . 2 month ago we canceled the direct debit and we're paying him cash. last month we paid the rent 150 short nd now he's sayin that he'll ad a 50 pounds delay fee for every day we delay the payement, is this legal?

The extra fee is only legitimate and recoverable if
(a) the contract provides for such a fee and
(b) the extra fee is reasonable, rather than seeking to impose a penalty.
You will know from the paperwork whether the first of these provisions applies or does not. As to the second, the sum is clearly a penalty and is unenforceable under English law.
That said, even without a specific provision in the contract, interest on the outstanding sum is certainly recoverable. But avoid the problem completely and simply pay up - on time! |

Check the lease agreement you signed. It probably stated that a late fee can be tacked on for inadequate payment. So give the guy a break and make a full payment, on time, every month. Cancel the cable and internet if you have to. Just pay your rent FIRST. |

Yes. This is just an incentive for you to pay your rent on time. If your late on your charge card payment they charge you 25.00, so that's why it's important to pay before the due date. |

The charge would have to be reasonable though and no court will say £50 per day is. |

Yes, late fess can occur with any late payments on anything. Rent, credit card, doctors, cars. |

They can if it`s in your contract but £50 is far to excessive, most companies/landlords charge only 2/3% a nominal fee....Go to CAB and get some advice... |
