I am a mother of 3 kids and i work in a senior center , Well more or less recently in the month of march i came down with a stomach flu my doctor told me not to work around food due to it being illegal with that type of illness,So i brought my boss and my supervisior a copy of his report.A couple weeks later i had began to get several sharp pains in my chest and after a couple days it was enough I went to the dr.s on the weekend making sure not to miss anymore days of work and i was diagnosed with bronchittis and i gave them a copy of that paperwork as well.Well i have been out of work for 3 days last week because the pains in my chest are unbareable. They still hurt but as off monday i will return.Well today my husband was at his job and one of my co-workers husbands were there and had said "she needs to realize her position needs to be filled and it makes it hard when she decideds to call out because she dont feel as if she wants to come in " My husband had then explained it again even though it was none of his business,then man said well tomorrow if she decides to come in she will get a lecture and probably a write up or dismissed.Now besides me being sick I am the only person who isnt related there my boss and everyone feels they can belittle me and talk to me how they please.I mean my job takes 30 hours to do and i am getting paid to complete it in 26 hours and when its not done because i run out of time i am told to volunteer that time and not to mention i am the least paid person people that get hired recently make close to 2 dollars more then me ,I mean frankly enough is enough i put up with the ignorant remarks the degrading of me and most of all they feel i speak incorrect due to me being raised in the city and i currently live in the country so please anyone with any advice at all please i mean please help but mainly can she fire me when i have proof i am sick? and i had called out because my job is mainly lifting but the pains in my chest hurt when i move it but i continue to get made as a joke there not to mention i am 24 the youngeest person there together

Depends on if you work in an at will state. Most states are meaning an employer can hire and fire whenever they want and for most reasons. |

2 separate issues.
1) If you work, you get paid, that's federal law. You don't 'volunteer' your time. Contact US Wage and Hour division.
2) If you are in an 'at will' state, then yes, he can fire you for any reason, or no reason at all so long as it does not violate federal discrimination laws. |

no you can't be fired for being genuinely sick - especially as you have a doctor's note to cover you. Do you have a contract? You are under no legal obligation to do unpaid work...how dare they tell you to volunteer your time? (Slavery's been abolished!) It sounds like they are taking advantage of your youth...you really need to speak to your union rep (if you have one) or your local citizen's advice centre...your employers rae taking you for a ride hon Get out of there! |
