Can my husband do this?

There is a social gathering tomorrow that I do not want to go to, nor do I want my kids to go. I told my husband to go by himself and have fun. He says he wants to take the kids...I firmly said no. He says he will take them anyways. Is he legally allowed to do this?

Yes. He has the same rights you have with the kids.
If he takes them to a bar or something like that, you can call the law on him for child endangerment, and I'm sure it will do wonders for your marriage.
You should come up with a compromise. Maybe you and the kids could go with him for a little while then leave early.

Unless they will be placed in a dangerous situation where their well being will be harmed, it is perfectly legal for him to do so.

In a marriage sometimes you have to go to places you don't want to go and do things you don't want to do. Why not support your husband and go with him without a bad attitude. You might have fun and strenthen your marriage instead of weakening it.

Do you want to stay married to him or not? Do you want a henpecked man or a man?

He is their father, unless you have a court order stopping him taking the children, of course he can take them out.

If you are concerned about their welfare at the event, go yourself. Why shouldn't they go, just because you don't want to?

Well..I don't think that you can kidnap your own children. As long as he isn't doing anything illegal with them he can take them. If you try to stop him physically and some one calls the police you both may end up in jail for domestic violence.

If its a KKK meeting, then take the kids and run...far away. If its a Star Wars Lego convention...its all good.

yeah, I think so. You guys are together and you both have custody rights. So if you don't want the kids to go you should take them somewhere before your husband has the chance to.

If you are together, which I assume you are, than yes. He has the right to take his children to an outing, as long as the outing is appropriate.

He is just as much their parent as you are. Of course if it's not something that is going to hurt them he has every right to take them and so do you. Why are you so controlling about this, is it a situation that would be bad for them? If they are in danger then you should step in but that's the only reason.

I think that it is his right to do as he wishes with the children. I am assuming that he is their natural father or legal guardian. I am sorry that this situation may endanger the kids due to his drinking, but as he is a legal guardian, he can do as he pleases with them.

Yes, he does. He has the right to take them and never come back, till you file papers compelling him to. Then if he stays gone it's a Felony. But not till the court gets involved.

But what's the big Deal where is this a stripper bar, or just people you hate. I'd go and watch over them. Better to hang with lushes for a time than let them get hurt, but be nice, no scenes. Be nice and clever, he'll be drunk anyway then you can go. Then get help w them and pick him up. Ask if he'd be o.k. with limiting their exposure to this drunken BS as alternative to your permanent departure.

I'm not sure but even as a visiting Dad, unless he has drunken issues you can document, he'd be able to take them whether you were married or not, on his weekends. So, if he's decent in bed and not a bad provider, you may have more control as the wife, rather than the x. The kids need their dad, but primarily and mostly and sober. I had an alcoholic step father, real drag at times. be careful, document stuff on a calendar at a friends house hidden away. Got to have proof witnesses and stuff and be sure to give him a chance(s) to fix it, if he's a drunk, which many are . It's a painful world, it's how they cope.

I know it's a bitc., but you both have equal rights. Sorry this is happening.

I just have one simple request. Don't let the kids see any of this BS arguing, please! They deserve better.

Follow your instincts though. One of my kids would be dead from a pool drowning if not for her moms instincts. Pray and listen to inspiration, truly.

Legally he can take his kids to a social gathering if kids are allowed there. If he has alcohol problems why don't you accompany him, the soul purpose of marriage is not only getting kids but also supporting each other... If you still refuse to change your mind. Keep one kid with you and let him take the other. After all your kid is not going with a stranger.

If you have a valid reason for not wanting your children to attend then he should respect that. If he were to take them anyway, I'm not sure it would be illegal as such...you'd have to report then as abducted and surely you wouldn't want to do that??! Whatever happens, I hope it all works out!

Yes he is legally allowed.I know you don't want to go,but for the kids sake if i were you i would go.You wouldn't want them to get in a car with a driver that's been drinking.Anyway you and the kids can take a separate car and just stay for a little bit.Then find some reason that you and the kids have to get back home.Good luck!!!

well if he is going to hurt them or do something then it is illegal so i would tell him no no no and ask to go to a restaurant

He can legally take the kids.
If he drives drunk or otherwise put the kids in danger, then that would be illegal. You can report drunk drivers to the police.

If your husband, is their legal guardian or father, than yes, he has every right to do that LEGALLY SPEAKING. Now if the place he is wanting to take them is dangerous or puts them in any sort of harms way, then you as their mother has the right to protect them, and not allow it. However, if this is the case: You might need to call the police for help. Also, you might consider just how healthy of a marriage you have with this man, It might be in your best interest to contact an attorney.
