Can my liscense be suspended because of this?
Find answers to your legal question.

Can my liscense be suspended because of this?

I got a problem guys, mostly caused by my stupidity. Last Friday on Fort Carson while i was at drill I got pulled over for doin 43 in a 30. Four point ticket. just pay the fine, and I'm good to go. Well today, I just got another. Went to pass someone, and by the time I got around them i was doin 76 in a 50. State patrol was heading the opposite direction, turned around, and came and got me. Gave me a summons to appear in court on 12/12/2007. Now my question is what do you guys think is going to happen? Suspension, points and driving school, ???

Last year i had three ticket. One for failure to yield(2points), one for following too closely(2 points) and another for 43 in a 35(2 points). So any help would be great guys, THANKS.

PS...yes i know i'm stupid

Well I guess it depends on the state, but, I'm sure you will have to attend a driving school (If not...do it any way) See what your state max points are...then you'll know.

ps...you must make huge $ to pay that kind of insurance, maybe you should just take a taxi!

Yes hopefully they take your liscence so the rest of us will be safer.

Go to your State's website and look it up. It will tell you what the maximum and minimum penalties are. It also may give you and edge to fight the ticket. Make sure the radar gun has been up to date on its calibrations.

Depends on what exactly you are asking. Is it possible to get a suspended liscence then yes it is possible. If you are asking is it likely that will depend greatly on the judge you have, your lawyer, and probably how remoreful you seem. Since they will look at the fact that you have a series of tickets in the last year the judge will be a little more harsh then if this was a first time or second time offence.

I do believe that chances are you will just end up with a fine, lose points and driving school, but if anything happens in the next year I am sure you will lose your liscence.

My brother-in-law lost his license for life, for DUI's, then got caught again driving drunk with no license and got his suspended for 5 years, I though oh, that is life plus 5 years. Well, he had them back in 2 years. Yes, it's stupid of you, but according to what county actually you are in, and how persistent you are. Be careful next time, before you kill someone or yourself.

auggiebetrue
i don't know much about that......... but being that you were summoned to go to court i would assume a large fine, or suspension. and don't be surprised if you have a hard time with car insurance afterwards. (depending on your location). so make sure you have someone go with you to drive home for you or someone that is going to stay home and you can call them if you need the ride.
hope i was some help.

i will say fine and suspension according to how things are done where you live. in this northeastern ohio area in a small town that would be your most likely punishment. good luck

Gawd I would hope remedial driving school, after a suspension, you have a blatant disregard for traffic laws! You are already up to 10 points not counting the pending case, but you don't say what month your record starts. 12 points in 12 months gets suspension, you still have time to hit 18 points in 24 months. 76 in a 50 gets you 8 points! You've made it, congratulations!

Oh, and your points are there for 7 years, I suggest growing up a bit before getting behind the wheel again.

The simple fact is that you have collected five tickets since the start of last year. You may get a lenient judge and get by with a fine and, maybe, a short suspension. However, I would not bank on it. Your record screams "I need to learn a lesson."

At least you acknowledge your stupidity (as you put it). That cannot do you any harm when you are standing in front of the judge. Personally, I would get a good traffic attorney and listen to what he tells you.

I'm guessing this in in Colorado? The prosecuting attorneys there are pretty good about plea bargains there. I got in a similar fix when I was stationed at Lowry AFB in Denver.

You could make an appointment with the prosecutor, they may give you a deal involving less points, or a non-moving violation.

If the prosecutor doesn't budge, try a no contest plea and talk to the judge. Your honesty should get you a deal. Volunteering for traffic school would help too.

I've never gotten a ticket... i believe it is possible to get your license suspended, going 26 miles above the speed limit is reckless.. i believe it depends on the judge.

Georgia
I was pulled over once for going 65 in a 35 and I had to go to court for it. I had to pay a fine, but I didn't have my license suspended or anything else. It was the only speeding ticket I'd had, I'm not sure if that makes a difference or not, maybe it won't.
Good luck!

they might. this happened to my brother and they suspended it for 6 months but he could still drive to work and to school

wreckless driving baybayyy, my moms a laywers sec and she gets everything together. you might want to get a hold of a magistrate and try to figure out the best thing for you to do, or contact a lawyer he can get it taken down so its not 26 over the speed limit.. so you should probably get a lawyer, thats def. your best bet !! good luck!!

IT sounds as if you DO need to go to the classes, for your own good, as well as for everyone else's; it's NOT to embarrass you, but to help you. Did the Officer say you could pay the fine before time for the Court? I got a speeding ticket; went straight to the Courthouse & paid the fine, so I wouldn't have to go to the court-date; then I willingly went to the classes, to keep the points off from my record. Here, you're only allowed to do that, one time. Oh, by the way, use your Cruise Control, if you have it.

TinkerBell
Ouch! My goodness, silly! You better slow down! It's going to be up to the judge! Better hope you get a nice one! Yes, you could have it revoked! Hopefully, they will allow you to go to through traffic school...got a lawyer who can plead this for you? A good lawyer would be better to ask. And you're not stupid...just maybe a little impatient?

fuzzymatt3
They are probably gonna make you pay a fine, and then just make you take lessons again, but i sereously dont know becuase ive never gotten a ticket. I have studied this alot in school but im not sure.

Phillyfan
I would do some sort of driving school or deferred adjudication on the 43 in a 30, only because I think there's a 15 mile over limit in my state. The 76 in a 50, you may need to eat that one.
I don't think your stupid, just driving a little too reckless. For the next 3 years, you are going to need to drive like your driving Miss Daisy herself. By then most, if not all, of these tickets will disappear from you DMV record. Good Luck...

jon_mac_usa_007
Lets hope they suspend your lic, it might keep you and everyelse on the road alive. Check out the link below, for what can happen to a teenager you won't slow down.

Im glad you can admit it...i don't think you 've learned your lesson. I don't know legally what will happen but if you do get your license suspended the roads will be safer! LOL!

well, in most states, driving over 20 mph over the speed limit (not on highways or interstates) will be an automatic C+N and will probably be a 10 day suspension.....if not, the points are probably like 5.....and suspensions usually start arounf 10 points....so you may be ok there......

Hell, in any case it probably won't be more than 10 days.
I lost mine for 7 years....I can do 10 days standing on my head.

firechick1721
depending on your state... here you are only allowed 12 points a year.... not a calander year but a year from the earliest ticket... if the tickets you got last year are within a year of this one, more than likely you will loose your license.. if you have already been to driving school, they probably wont send you back, but might.... you will get fines, points, possible community service....

-- Aliicat --
I don't think they'll suspend it, as long as you show up for court and are well behaved in court. The only thing that happens is your insurance will probably go up!

i dont know about this point system, but i have a friend that has 14 tickets on his record, hey pays about 700 dollar a month for insurance, but thats about it.

m.cline49
Dude they need to take your license away before you kill someone. Glad I don't live by you.

☆Amanda☆
they will probably just give you driving school and a fine.

who in their right mind would give you a lisence after three tickets???

depending on your DMV they can have it taken away or suspended--every state is different--

with your driving habits you may need to have the license gone

Probably points at the very least and at worst, suspension of license for 6 months.
