Can my mom kick my sister out if she's 18 but still in high school?

My sister will turn 18 during her senior year. She'll have 6 months left of high school when she turns 18. My mom says she is no longer welcome to live there after that. Can she do this if she is still in high school?

You will need a legal opinion on this. I'm neither a lawyer and I won't to go to the law library to research this for reasons stated below. Your best bet is to have your sister contact legal services organization in your area. You didn't mention which state you are in, the laws may vary from state to state. Your sister may also want to contact the school system. There could several complications here like the terms of a divorce settlement. Sometimes divorce settlements even specify which parent is going to pay what portion of college expenses.

If your sister can afford it she may want to hire a lawyer. It's best to get one who specializes in family law. Otherwise, she may want to contact a legal services organization or other organization who offers legal help to the poor.

Further, it should be considered what is psychologically best for both of them and the whole family. It might be a good idea to bring a family counselor into the situation. A legal solution may be made but it will be of little value if the parties involved are hating each other.

Your sister should look into this herself unless you are trusted by both your sister and your mother.

If she is interested in going to college she may be able to get early admission and financial aid which she can live on.

I suspect what is really needed, more than anything else, is some form of family counseling.

Yep. I moved out at age 16 and had to work nights and finish high school. Tell her to behave, it's in her best interest. A lot easier than living on your own at that age.

Yes, when you turn 18 you can be sent on your own. Maybe this will teach you that your parents home is exactly that. Have respect, maybe you can stay longer.

By law your mom is responsible for your sister while she's in school after that once she's graduated your mom can kick her out. Some parents are like that once you hit 18 they want you gone so they don't have kids still in the house since you got some who won't move out and experiece life. Your mom may have her reasons for putting your sister out and telling her she's no longer welcome to live there. Just be prepared because she may do the same to you so have yourself in order so when she kicks you out you're prepared. A lot of 18 year olds are ill prepared for the world so that's why you need to save up money from your small jobs and get established.

YES! She is 18. She needs to accept your mother's rules while she lives under mom's roof, or she is out.

Good for your mom -- too many spoiled kids are let to live at home years after they become adults and they never appreciate what their parents did for them

without a doubt, your mom can kick out your sister. This is because she is "legal" as an adult. however it is immoral to do so because she is still considered a child to society. but of course it also depends on what your sister has done to make your mother kick her out

Check with your state laws... in some states even if they are 18, if they are still in highschool minor laws still apply... to avoid drop-outs

She can, but it may back fire on her...

In many states a child is the parents financial responsibility until they are 21. Which means that while they can make them leave the house, they are still financially responsible for their care. If your sister tries to apply for social services to help her pay for rent or food, social services will contact your mother and tell her that she either needs to allow your sister back in her home or she will be billed for any services your sister receives.

Have your sister call your local department of Social Services and talk to the counselor at her school. She will not just be out of the street, even if your mother does kick her out. There are services available. The school and DSS will assist her in finding housing until she can begin working after graduation, or go off to college.

Edit: exception to this rule. If the child is abusive to other members of the household or breaks the law multiple times, the parent can petition to remove responsibility. So, your sister better be on good behavior.

I'm so glad My Mom isn't that way.
