Can police seize tobacco from minors in New Jersey?

My cousin's son just recently turned 17 years old and his parents are now fully aware that he smokes. However they have no control over the situation anymore because he works and therefore pays for the dirty habit(addiction) himself. Recently he was smoking with a few friends on a main street bench when a police officer pulled over and saw them smoking. He made them all empty their pockets and ended up taking away their cigarettes even though tobacco use is not prohibited by minors in New Jersey. The officer acknowledged that smoking was allowed in that area so it was not a no smoking zone.Is this legal??

I'm not his parent or guardian so I DON'T have control over what he does or what his parents say. His parents can do what they feel. If you read the question fully you would've known that. I ask the question merely out of curiosity because I've had past experiences where police have abused their powers. If it were under my control, I would have him stop immediately but unfortunately I can't so just stop talking now you idiot.

It is illegal to smoke under the age of 18 in NJ. In fact, an adult caught smoking in a car with anyone under the age of 18 is subject to a $75 fine.

seeing as how its illegal to smoke under the age of 18 then umm yeah cops have every right to take it away. and you are wrong. just cuz he can pay for it doesnt mean they dont have or can not gain control of their sons issue.... dont think that for a second....job or no job they are still his legal guardian until he is 18
