Can someone sue or press charges against a blogger who posts damaging or negative stuff about another person?

If you have rock-solid evidence, you could bring defamation charges. Libel is written, drawn, photographed, televised, etc. type of of defamation that intends to harm another person's character.

To the first poster, slander is spoken defamation, libel is expressed in other forms. I don't mean to sound saucy, if I do, but libel IS the correct term for this type of defamation.

Jigi, since I believe you are the one who thumbed down my response. Eh? Your response makes no sense. If something someone says is damaging to another person and ruins their character or reputation to the public for no justifiable reason, he cannot say it freely without penalty. If it has already been proven the person has done this, that, or the other, then someone can say whatever they want. But you can't just start blurting things out on a blog that is damaging to another person unless you want repercussions for your actions.

Btw, if some of what he says is true, well, I don't see a case for that. Seriously, now. If some of it is false, you have to prove it. Since you are the one bringing the action, you have the burden of proof.

In most places, truth is a complete defence to an action for defamation. That is to say, you could sue him but you would lose.
And as the second answer points out, this would be libel, not slander.

if you can prove its kept you from or reduced your income, then libel/slander is an option...other wise its waste of time to pursue legal channels on this one....

You can sue for libel or you can file criminal harassment charges.

Get a lawyer to write him a letter telling him that you will do both unless he removes the entire website in 24 hours.

Yes, that is referred to as slander. It is usually pursued in a civil court.

If it is true he can say it without penalty. If you take him to court you will also be put on the stand and asked if it is true or not. You have no 5th amendment right to silence in a civil case. If you lie and are caught lying you will go to jail for perjury.

So if it is true and he has no proof just call him a liar because if you take him to court you may just confirm it all.
