Can sue ex for publishing personal naughty pics?

If he took the pictures, then he owns the copyright to them, and he can post them anywhere he wants to.

Sorry, but that's the law .... so always get your naughty pics back if you let someone take any.

the courts would be flooded beyond belief if you could sue for something like that. if the pics were stolen from you and a 3rd party posted them, that's a diff story, like the ones you hear about hollywood celebs suing. the internet is flooded with pics like that so yours are just a raindrop in the sea.

if you did want to sue for some reason, be prepared to come up with $$$ for a retainer for an attorney, it won't be an inexpensive action.

The only thing I can think of is intentional infliction of emotional distress, but its a really tough case. That would probobly be the proper cause of action, but you won't win. Just move on with your life.

Here is the test for it, and the application to your case:

1) intentional or reckless act
2) of extreme or outrageous conduct
3) which causes
4) actual emotional distress

you would have lots of trouble with prong 2 and prong 4. Generally, you need to show tangible, serious distress (ie needing therapy) for prong 4. Prong 2 is also doubtful, since lots of people post pictures on the internet.

The injunction is definitely not going to happen. I can't even think of a coherent legal argument for it. Besides, once something is on the internet, taking it down doesn't help much, since it could already be copied. Sorry.

I think you can. Find a lawyer. If you know one or know a cop, ask them what you should do. (assuming it's someone you don't mind talking about this with).

even if u think ure gona lose, still speak to a few different lawyers until maybe u find one with experience in that. You should try at the very least. Pretty nasty guy. Be careful if you take this into your own hands. Don't you have some nasty pics of him? LOL

Im not exactly sure what will happen,
but you should atleast call somewhere
and get a lawyer if your gonna take him to court.
The lawyer will inform you of all your rights...

Any individual has got the right to privacy. You can sue for causing mental agony and loss of reputation, by his act. You may have a notice issued to him to forthwith remove all those obnoxious pictures from the web site and issue him suitable warning.

Your best option is to consult a lawyer in your area familiar with the laws of your area. You can try to sue for invasion of privacy, but if you consented to being photographed it could be a problem.
