I am not a legal eagle, but I could see a defense attorney arguing that the club created the desire to want more drinks, and had that catalyst not been present in the beginning, then the desire wouldn't come to fruition. This is assuming that the club gave the first round of drinks away for free? |

you would just as responsible if a friend comes over to your house, gets drunk and leaves and gets into an accident.
It is a personal thing because they were the ones that chose to drink and drive not the organization. Alcohol is legal even though its more harmful than marijuana. |

basically it is your decision on how much you drink its like going to a restuarant they are giving you the drinks becuase they have a permit. i mean they could cut you off but most of the time they will just keep getting you drinks because you do want them. And it isn't there decision for you to go out driving drunk or walking the streets drunk so no they should not be held responsible but yes laws do vary. |

on thier property yes, if they have signs up about drink at your own risk or swim at your own risk thats that persons own fault then.
But yes the person who drank it deals with the problem you only had it there. |

The club could be held responsible. If you had someone over to your house for drinks and that person killed someone on the way home in a car accident, you would be liable. Your club probably has an insurance policy that states what you are covered for and what you aren't covered for. Doing things like providing a car service to drive inebriated people home or having security there to watch for people too drunk to drive can mitigate your responsiblity or at least show that you took reasonable steps to prevent accidents if it went to court. |

Laws vary from state to state.
I don't think the club would be responsible , typically a bar/club becomes responsible if they keep serving an obviously drunk person. |

Personal responsibility is hard to find these days. Yes everyone would benefit if individuals made decisions that would not hurt themselves or others. However, if an member of your club does get in an accident and is injured or killed I am sure the family members would hire an attorney to hold the club somewhat responsible, especially if the club is doing some of the purchasing. |

It depends on where you live, however it seems more and more people are getting charged if they were providing the liquor or if the drinking was happening at their own homes. We should all be responsible for our own actions however, if you know that someone was too drunk to drive and let them don't you think you would feel horrible for not taking thier keys if they killed someone? or themselves? I personally will pay for a cab or drive them home myself if someone is drinking at my house because i don't think I could live with myself if something happened. |

I'm all for having a drink and having a good time... but given the situations... it doesn't sound like a good mix to begin with.
The club would probably be held responsible for 1. supplying the alcohol and 2. allowing more alcohol to be distributed.
But that's just my opinion. |

If everyone is "of age" the it is personal responsibility unless someone has an unbelievable attorney (lol). If they are underage, there would be major repercussions. |

If you allow someone you know is drunk more alcohol or
allow them to drink more, or give them more alcohol. I suspect you would be held responsible. In Canda our Supreme Court has upheld this law. There are cases where people have gone to office parties with open bars and got drunk and driven and been seriously injured. They have successful sued their employers and the people who served them the alcohol. It has also happened to people who have private parties and serve too much alcohol. Even if the
accident is the drunk's fault they can sue successfully. I would warn people to be very careful about how much alcohol they serve at parties and gathering and if you know someone is drunk do not allow them any more alcohol on your premises and if all possible take their keys away from them. If they insist on driving call the police. This would lessen your liability if anything should happen. Laws tend to be very similar
in Canada and the US as we both base our laws on English common law. Plus if someone is seriously injured and goes to a lawyer the lawyer will sue everyone in sight because he wants to get the most for his client and he knows insurance
companies have 'deep pockets'. |

why is a swin club allowing the alcoholic drinks the could lose there insurance coverage if they ever found out and yes they could be held responsible depending on the seriousness of the accident and if the person drinving from the swim club was found to be drunk beyond the legal limit. Keep in mind 1 drink can put a person over the legal limit if given a bretherlizer test. So be careful and take keys if people are drinking so you have control over who drives and who doesn't. |
