if you signed an agreement with DA where you admitted guilt to a misdemeanore domestic assault charge...can you change your mind after a week or HOW LONG can you wait to do this?
can you go to the DA and take the first offer they were offering where they offered ALLOWED contact with victim if go and see a mental health doctor??
but if you talked them to not seeing the doctor in but you are court ordered for NO CONTACT for 1 year,, can you change your mind?
how so?
or can THEY ADD TO the already signed agreement then and say that you need to see a doctor as well as NO CONTACT after?
(especially if you go to them now and try to talk to them again?)
please explain.

Once an agreed plea is entered then it is possible to change your mind at any time up to and including at the trial. However, if you change your mind on the plea, then you should NOT expect any previous offers to be valid. By changing your mind you are causing the court and the legal process time and effort, and they may well choose to simply allow the judge to adjudicate which could (and probably will) mean that you will end up with a harsher pennalty if found guilty than was offered under the agreement. That is why agreement arrangements exist - solely to save the court system time and money in exchange for co-operation from the accused. you stop co-operating, you don't get any benefit. So yes, if you ditch the current deal, there is every likelihood they will go for no contact plus the psychiatric care requirement. |
