i am being sued by a former employer that closed in 2005 and he filed with the court in 2008 he is charging me interest from 2005

Interest can only be charged if the original agreement with the creditor allowed for interest to be charged.

It depends on the law of the state where the action happened and what he is trying to charge interest for.
