You can take it to them, but you may not be able to. If it is a religious reason, maybe. Good luck...I worked at a factory & we had odd times to have to work too! Glad I am outa there! |

You can't collect unemployment if you've been terminated for cause.
Refusing to work is cause. |

You might not collect if they fire you due to insubordination. |

Only if you are improperly fired. They must have given you two previous warnings before they can fire you. You can always apply and even appeal if it is denied. |

Yes, you can collect unemployment if you are fired. If you are refusing to work on Christmas due to religious reasons they can't fire you, unless you work as a nurse, doctor, EMT, policeman, fireman, etc. where your lack of presence would be harmful to others. |

Yes, you cannot (in my state at least) quit. |

Definetly. You can't get it if you quit. |

Yes but you have to both state your reasons and it's possible you may lose. |

They can not fire you for refusing to work for religious reason. If your religion prevents you from working Sundays and religious holidays i.e. Christmas and Easter.
However if you refuse to work the company will no doubt make you so misserable you will want to quit. Your schedule will be terrible and EVERY review you get will be critical. I suggest you look for another job. If you are working on Christmas you are probably working for a convience store or some retail and barely making minimum wage those jobs are a dime a dozen. |

If you have been employeed with the Company for six Months or longer then you may apply for unemployement. The final answer in most cases will come from a Judge. Companiies frown on paying unemployement and will fight it in Court. By experience I was taken to the cleaners. Why? The Company owner was worth multi-millions and could afford a good Attorney. |

Depends on the state.
You would probably lose that battle in Texas where 80% of contested unemployment cases side with the employer.
Better do your homework before you do something rash.
Why not work out a deal with your employer??? |

The job centre can say you deliberately lost your job through misconduct so you no you wont get the dole. |

That would depend on the rules of your state. I know where I live if you are fired for good cause (i.e. drunk on the job, insubordination) and just not let go, you may not be able to get unemployment.
Best thing to do is check the laws/rules/regulations of your state's unemployment office or simply call one of those nice individuals at the counter and ask. |

no. You cannot collect unemployment under these circustances. If your company is open for business on Christmas and you are required to work, You have 2 choices: either work that day, or quit before Christmas. You can only collect unemployment if you are laid off or something like that. Sorry :( |

yea i did
however i think it depends on why you were fired
i was fired due to cutbacks, i know that should be laid off but some how its not, i think it has something to do when the company and the way it was filed.
if bad.. i think you still can but not as much pay will be coming. |
