Yes and yes. Doesn't mean they'll grant the restraining order unless there is still a threat (which there usually is). They'll want to know why you didn't report it right away. There's gotta be some kind of time limit, like why would you report a single incident a year later? Keep records of all incidents, record if you can, save threatening voice mail or email msgs, take pictures of bruises or cuts. Stop associating with an abusive person, THEY DO NOT CHANGE.

Yes, but there usually needs to be some evidence of the fact, which maybe long gone after a week. Without substantial evidence, you probable won't get a restraining order.
