My fiance has been working at Dunkin' Donuts since Tuesday for so called Training He has everyday since then and has not been paid. They tell him he will not be paid for this time. He was supposed to get paid starting Tomarrow but they want him to work another whole week (tomarrow till the following monday) for training without pay. He was already completed the online training before even starting there and he passed the training test given to him today. Isn't this illegal? Additional Details They are not clocking him in what so eveer. Does anyone have any website of proof that this is illegal

Yes, it is illegal. The only type of work you can legally do in Michigan without pay is volunteer work or an unpaid internship. If he filled out his W4 form, they are violating state labor law. Have your friend contact the Emplyment Security Commission or Attorney General Mike Cox's office. |

I am not sure about the legalities, but it seems fishy to me. If a legitimate company hires you, you should be paid if you are working no matter if it is training or not. Is he clocking in, or are they "writing him in"? If they are keeping his time on paper I would ask to see it. |

Michigan or not, what they are doing is a violation of *Federal* labor laws. Any time spent "under the direction of the employer" is paid. Period.
He can contact the Department of Labor. He can also contact Dunkin' Donuts corporation. DD stores are Franchises, which means the store is run by it's own individual owner. The Franchisor though - Dunkin' Donuts - is NOT going to tolerate one of their Franchisees violating the law and getting them bad press. If he calls them, they will come down on the store owner like a sack of bricks. The owner could even lose his Franchise over something like that.

It's illegal. And what this employer is doing is not just a violation of legal rules. Iti's a felony in any state in America.
I suggest your fiancee get out before they do something else illegal and set him up to take the fall. If he's got a record of the time and you are in a position to do so, he also has grounds for one hellava lawsuit. But he needs to get out--NOW. |

Sounds like they are ripping him off bigtime. There is no need to pay you for say Work Experience, but training yes. Contact your nearest Labour exchange or Union office. |

Certainly does not sound legal or ethical to me. Unless he perhaps signed something regarding unpaid training and I don't think that would be legal either.

I'm sorry, but your fiance is a dumbass if the store doesn't trust paying him yet for trying to select the proper doughnut and/or coffee. You should dump him, you will never be happy with an uneducated loser. Tell him that he's a worthless piece of trash that does not deserve your love and care. *****. |

No. Work must be compensated. Some states have training wages, which are lower than normal wages, but those have specific rules attached to how they work.
Breaks are also mandated. They vary someone state to state, but generally, there must be a break for lunch - can be unpaid - during a period of work- 6 hours some places.
Each 4 hour work period usually has a 15 minute break - sometimes paid, sometimes not.
Check with your states wage and hour department at the Michigan state web site. |

Tell him to put it in writing, that he has already worked a full week, and the following week....then take it to a lawyer. They have to pay for training...but make sure he gets that in writing. |

It depends on what was told him.. Does he drink much when not working? It seems kinda stupid that a training worker should insist on pay.. They take their time and it costs the business the time of those who train you! Is this a ploy to support their competition? It is not politically correct to have this here. It is best to ask.. is this right? That is a moral issue and that must take precedent in our corrupt society! Call the ACLJ for moral help.. and ask, is it right.. the ACLU, a Communist fronted organization, will tell him to leave that job! They favor no moral values! There are moral busines values too!
