I am 15 right now, but I will be sixteen within a few months. I was planning on graduating early, but I need to get out sooner. I am looking to move to California. I have looked into emancipation since I was 12 and it will cost a good amount of money to file it, not to mention trying to reason with a judge as to why I need to move out.
If my mother (I dont have a father with me) says yes to let me leave at sixteen, would I be allowed to move out without being hunted down and taken back home? Or do I have to follow through with emancipation/and or wait till I am 18?
Best answer gets best answer. Additional Details I read through some answers and I can't believe what I am reading. I do plan to attend college, and my decision is not based because I hate my mother or I have a bad life...I just want to get out on my own and start living my life. I OWN a car and want to rent a room, not an apartment. Care for a better answer?

With that you have to have a full time job place to live and prove that you can do it on your own. I do not believe you can move out of state till your 18. But your state may be different from mine. In Iowa there is no longer an Emancipation rule. And that only goes for situations like mother of father abuse you or something like that. Not just cause you do not want to live at home anymore. You are 15 years old. I do not know your whole situation. But if its not that bad then why not just live with your mom you need eachother... |

With your mother's permission you can live wherever you damn well please. It's only without her permission that you would need emancipation. |

I think you should talk to an adult at school. someone that can be trusted and give you good advice. Really, a counselor or a teacher can lead you in the right direction. |

If your mother agrees you can move out. However, she is still responsible for your actions. You will not be able to sign contracts until you're 18. So you need to find somewhere to live that doesn't require a contract, like a friend's house. That's the why of emancipation.
I moved out at 16, I had a high school diploma, no job, moved to a friend's house in another state. With parental permission, you are most definitely allowed to move out. If you do anything wrong, your mother can still be called about it. As long as you don't get into trouble, you'll have no trouble. |

You can move out, but there are several issues. In many states, your parent remains responsible for you until age 18 which in fact makes it illegal for you to move out. Until then, you are considered a minor and your parent is responsible for your care. You cannot legally rent a house, buy a car or any other activity that requires you to enter into a contract. |

Someone else asked a question like this, and I'm going to tell you the same thing. It is illegal to move out on your own at your age. You have to be 18 and up to move out and get your own place. However, if you are living with someone else, thats legal. As long as the person you are staying with is a capable guardian, then its fine. You will also have to fill out papers if someone is taking you in, otherwise its not legal adoption. |

It would be more worthwhile to wait until you are 18, as it will cost a lot less time and money in the long run. Emancipation at 16 is rare unless you have a really good reason behind it. If it's as simple as irreconcilable differences, then you won't be granted emancipation. And if you were to leave, you'd probably be hunted down and taken back home. |

My goodness, you must not like your mother. Just think about this, if you force her to let you go, then don't look for her help when things go bad. Remember this your mother will always, always, love you when all others are gone. Don't burn your bridges after you cross them, because there may be no way back. It's a big world out there, and all isn't good. Your going to have to have a place to live, witch means you'll need to get a job. Rent on a place might cost you over $2000.00 to start out with, then comes your lights & gas deposites, the some furnature, food, and transportation to get around. Don't let some freinds tell you they will help you out, because it never comes, they will have their own problums to deal with. Think before you jump. |

you can leave now if your mother doesnt care. as long as you have a job and a place to live. It can be tough to live by yourself. But if thats something you think you can handle then do it. But no, just make sure you can support yourself and that your mother is ok with it, always have an exit plan, if things dont work out make sure your mother is willing to help you out or let you come back home. DO NOT LET ANYONE TELL YOU U YOU CANT DO IT THAT BUGS ME YOU CAN DO ANYTHING YOU DAM WELL WANT TO DO, LIFE IS HARD NOT IMPOSSIBLE. |

If your mother allows you to move out at 16 then yes, you are allowed to leave without emancipation (in some states emancipation is nto even legal or recognised.) There is the chance that your mother can call up and report you missing at any time however. |

It is possible, but it is NOT a good idea. This is probably not the answer you want to hear. But you need to finish highschool to get through life. however, if you do infact move out, their are highschool degrees you can get online, along with college degrees. and so with exstensive and careful planning, it might make a happy and decent life if it is what you are truly looking for. |

You do not own a car, since you cannot have a title in your name until you are 18. And no, you cannot leave home unless you are 18 or are legally emancipated, whether you have parental consent or not. And if you are not in an abusive situation, your emancipation application will not even be considered. Being in a harmful or abusive situation is a requirement to get emancipated, that is the only way. I know you are in a hurry to grow up but you need to slow down and enjoy life as it comes to you, as soon as you've lived on your own for a few years and see how hard it is then you will be wishing you had this back. Also remember that you will not be able to rent a place to live without credit and sufficient income. You cannot have credit until you turn 18 so that's automatically out, especially since you will also need sufficient income. To be able to rent you are required to make at least three times (usually four and sometimes five) the amount your rent is each month. The cheapest place you'll find to live in California would be a little under $1000 per month, not counting utilities and your other bills. So unless you were making at least $4000 per month (which you won't be able to since no 16 year old could qualify for a job to make that much money, nor would you be able to work enough hours to hold down the job in the first place since you are still in school) then it is completely impossible. With that combined with the fact that you don't have any credit, and won't be emancipated, leaves you with no choice but to wait until you are 18. |

Talk to a counselor about it. I don't know the state laws in California, but in my state there are special programs where people between 16 and 18 can live in their own special apartments or in shared housing to learn to become independent from their parents. Different states probably have different programs, and I'm sure there's a way to get permission without spending tons of money. After all, most kids who really need to move out early don't have that much, so I doubt the government would make that the only way. |

I moved out when I was 16 and it didnt cost a thing. My mother signed over legal gaurdianship to my sister which she lived in the town that I moved to. The only thing that we had to do was get it noterized with my mom and sister there at the same time. |

you need to be `8, or emancipated, but what most people don't know is you can own an appartment, but the down side is your parents need to co-sign for it, which if they are okay with you moving out, it's not such a bad thing. a problem with emancipation is yu need a really good reason to want to become an adult and the process takes so long u'd be a few months from 18 by the time u were emancipated. another possibility is official (with lawyer interaction) parent written consent for you to live with your friend |

technicall yes you can. My sister did, but her life is now a wreck. She didnt finish high school, so she has trouble finding a job, she got pregnant at 22, unmarried, her boyfriend who had got her pregnant, dumped her and the two never talked again, then she was left to raise a boy all alone. Then she got married, and 8 years later after having two more children, got a divorce, then she met a new man, who got her pregnant, but she had an abortion because she couldn't handle 4 kids, espececially since she was going to dump him soon anyways, she was only with him for the money, she needed help financially, but that will never be me, since I plan to finish high school and become a lawyer, parelegal or CEO. ( I can take over my daddy's buissness )
and then maybe get married, have 2 kids, after I'm like 29 or 30. Have a few pets, and go from there, if theres a divorce, I'm still rich from my job, and I don't have to many kids to handle, and I can make him take one or two of the pets ( depending on how many and what ) |
