He shouldn't, but he does.
There was a big article in the New York Times about this a few months ago. You might want to check it out from their website for more information. |

It depends on what the pictures are but as far as a "right" you have posted something in a very public place, you have no expectation of privacy on a myspace account. |

Your employer didn't dig into your personal life. Myspace is a very public place..As to firing you, it would depend on your job and the picture. If you were nude and lewd and your job was in a daycare then your employer would probably have grounds. Just my opinion I'm not a lawyer or anything. |

You didn't give details about the pics.
What were they?
And, accessing your Myspace page doesn't sound like sleuthing to me.
YOU put your personal life out there. |

He can fire you for any reason. He's the boss. |

Employers will and can fire you for whatever reason they want and blame it on something else and get away with it. They do it everyday. Same with hiring. They aren't suppose to discriminate, but they do. Very sad |

Most employers have a right to terminate your employment for no reason at all.
If there was something inappropriate on your website, and it could be traced to you; it could damage your employers business.
He has every right to protect his interests. |

FIRST AN EMPLOER CAN FIRE YOU.
SECOND CAN YOU SUE
THATS IS FOR AN ATTORNEY TO DECIDE
IF YOU ARE MAD ENOUGH HIRE AN ATTORNEY.
ONE SHOULD NOT POST NOR USE INTERNET AT WORK ECT-
NOR LET PERSONAL CONDUCT GET ON MYSPACE---
FROM HOME |

people have been fired for that. a guy that worked for a major beer company had a pic of him drinking another beer brand with his work shirt on and got canned. usually there is somehting in the "code of conduct" about that sort of thing. also some employers check myspace to find out what kind of person they are going to hire. |

most employers know how to work around any laws impeding their desires |

actually all depends on your state if you live in what they call a no cause state then yes they can these states can fire you for no reason and probably get away with however if this picture has no reflect on your job then they have no grounds.you really need to call a free legal line and find out the laws in your state for job termination. also you need to add details to you question like what kind of picture and what type of work you do. but you are entitle to unemployment immediately |

Yes they can. |

The law can be a "funny" thing - what kind of pic was this?
Lately, whatever you post online if "Fair Game" as I understand things. Then again, am not a lawyer here. Suggest you look for a good one and erase whatever you have online, available to others!
IMHO,

More info. please.
Do you work at McDonald's and on your myspace page you have a nude picture of yourself with a sign that says McDonald's kills babies?
It makes sense to do a simple background check on employees looking at places like myspace.
I'm guessing that it might just be a personal thing that you're employer doesn't like about you. If you really think it's unfair, talk to a lawyer. |

Your employer can fire you for any reason at all,any time they want. But they can't stop you from filing for unemployment compensation unless you were fired for breaking some company rules, like not showing up or stealing something. |

Many states have "at will" laws regarding employer's rights to fire an employee. Here in Texas, for example, you can be fired for anything the management considers to be inappropriate. If you're in an 'at will' state then you're hosed. If you're in a litigation-happy, pro-bad-employee state such as California, sue them and do your bit to help to ruin the state's economy & reputation. It's tradition.
But next time, carefully consider what you post about your employer on any public website. It can indeed come back to bite you on the butt when you least expect it. |

Depends on what state you live in and what your employment relationship was. If you live in TX or GA, as an example, employers can fire you for no reason at all. But if you are covered by a union contract, you may have other employment related rights.
Oh, and if you post soemthing on the web and yoru employer finds it, they are not digging deep in your personal life. You are making something public and they easily found it. Hope you learned a lesson on that one. |

I feel certain that my employer will not fire me because of something that is on your myspace page. |

Most lawyers have free consultations, why not call and ask one. Now if you were on your myspace while on the clock and on the company computer and if there's rules about that then maybe. |

I dont think they have the right. If they are going to be that stupid then that isnt the type of company you should work for. |
