Caught smoking weed in dorm?

Last night I got caught smoking in my dorm room with a friend. The resident manager, RA, and police officer came to my room. They didn't actually catch me doing it, but they said it smelled like weed. I'm pretty sure someone told because why else would they come straight to my room when I have 3 other roommates.
Well the resident manager told me to come to the housing office monday morning so we could talk about what happened.
So should I deny it? Because they have no proof that I was actually smoking weed, other than the smell but they didn't see anything. Or should I admit to smoking but say that it wasn't weed I was smoking?
I just don't know what to do, I don't want to get kicked out of the dorms.

Do you really think they will be kind to you if you tell the truth? "Yes I was breaking the law, and the dorm rules, by being in possession of an illegal drug, which I was using to get high."

What do you think they are say? "Oh we love your honesty, we'll let you off this time?" Of course not. They will use your confession against you, and make an example of you. They will kick you out of the dorms, and there is a good chance you will also be kicked out of school.

So take this as a reminder as to why it is really stupid to smoke weed in the dorms, and don't do it again. Then move on.

Deny everything. I wouldn't even admit to smoking a cigarette unless smoking is allowed in your dorms. Tell them your burned some food or something. Or just flat deny.

Why lie about it? It just blows your credibility sky high and increases the chances that you will be kicked out.

There are two issues here, criminal liability and the school's disciplinary proceedings.

You should have no problem with the criminal liability because the officer did not have a warrant to enter your room. It is your university's policy to permit entry to your dorm room, but you don't leave your Constitutional rights at the door. In addition, you were never caught with marijuana in your possession. There is significant reasonable doubt here.

The second issue is your school's drug policy. You should check your university's website to see if they have a zero tolerance policy. If this is the case, you could face 1 year suspension from the university if found in violation.

There are a couple things you should know about school disciplinary proceedings. First, you have a constitutional due process right to a hearing and possibly an appeal of the hearing. This applies to private universities as well, unless they refuse state and federal funding (most likely they will accept millions in free money). In the hearing, you will be given the chance to produce witnesses, and the officer or roommate will have to come and testify. You will be given the chance to cross examine them.

Most likely you will be given the opportunity to have an adviser. The adviser is sorta like a defense attorney. Alternatively, you could hire an attorney to take the adviser's place. You can also go solo, but it is a very good idea to have a little advice.

Because the housing director could testify about whatever you say, it is best not to admit what you did to anyone. This is like confessing to the cops, just not a good idea.

There are some good questions that you could ask those that would testify against you. Keep them to yes or no questions (these are known as leading questions). Put words in your accusers mouths.

"Isn't it true that you never saw anyone smoking marijuana?"
"Isn't it true that you never discovered any marijuana?"
"Isn't it true that you never discovered any pipes, bongs, blunts, or any other device used to smoke marijuana?"
"You have no idea how many people were in my room at any point prior to when you came in, isn't that right?"
"All you know really for sure is what you observed when you entered my room isn't that correct?"
"And this smell that you describe, because you never saw any device used to burn anything, you can't say for sure where it came from, isn't that correct?"
"And because you don't know for sure who was in the room before you entered it, you can't say for sure that this smell you describe came from me, isn't that correct?"
"Are you an expert in marijuana smoke?"
"What sort of training have you had in identifying drugs?"
"Isn't it true that you have had no training in identifying the age of herbal smells."
"So, it's fair to say that you would be unable to determine if the smell was an hour old or three hours old."
"When you entered my room, you smelled the air, but you didn't go around smelling my bed, isn't that true?"
"And you would have no idea where the smell was coming from, particularly my bed, isn't that correct?"
"And you can't testify whether there was a particularly foul, herbal smelling person in my room before you entered, isn't that correct?"
"And you can't testify as to whether this person's smell rubbed off on my bed clothes, isn't this correct?"
"and you can't testify as to whether this person's smell rubbed off onto my own clothes from his, isn't this correct?"
"and you can understand the particular embarrassment that can happen when your love life comes under scrutiny because of the particular bad habits of another individual, can't you understand?"

change the person to a female, and the conduct board may be shamed and embarrassed into believing your story. Because hearing boards are confidential, your testimony can't leave the board room. If it does, you can get those people kicked out of school/fired.

If a police officer came to the dorm and smelled weed, then you shouldn't deny it. A police officer can use their discretion, and if he wrote a report that you were smoking, then legally you were. You could get a lawyer...but I wouldn't bother.

You could try to say that you were smoking clove ciggarettes or something. They smell nothing like weed, but they have a different scent then ciggarettes. Use your discretion, if you think you can get away with lying, then try it! But, if you do lie, and the RA knows you are lying, then they will probably hate you more and punish you more severely.

Honesty can get you a long way!

You shouldn't get kicked out of the dorms for one offense. If you have other offenses, then you may get kicked out.

Man up and admit it. You were wrong. You are living on school property, supposedly their to get an education, and doing an illigal drug. You were wrong, don't be even MORE wrong. The other resident students there to learn have a right to not have to live with someone doing something illigal, and putting the building at risk of fire.

i always deny everything. when i smoked as a teen i always used to deny it everytime i get caught. but the housing manager probably would class this as serious, so if you get caught out lying i duno what would happen.

Hope they kick you out. Dam ,it is a privledge to be able to go to college in American. You can only afford it if your rich or minority. And besides I don't want a pot smoking doctor looking at my XRAYS

Hmm, if you wanna be a good person, you could just admit it and suffer the consequences. (aka, jail) Or, since you really wanna stay in the dorms, you could just lie about the whole thing and blame it on your friends, but then you would lose a couple friends. Next time, just try not to do things illegal??

Do not admit you were smoking weed. Say it was something else and that it won't happen again.


Even though they know you were smoking weed, don't say you were. Just tell them it won't happen again.

Say you had a friend stop by to grab something and he/she had been smoking it. Sometimes the smell lingers. Or you could say that you were smoking it outside and the smell must have followed you in. One of those two, the second one is closer too the truth so it might be easier to say.

Or you could play innocent and say your friend was smoking a funny smelling cigar with you and didn't tell you what was in it lol.
